  • [01] TV interactive : la Commission réaffirme son soutien à des normes d'interopérabilité ouvertes, mais estime que la mise en oeuvre ne devrait pas être rendue juridiquement contraignante

    Les Etats membres devraient continuer à promouvoir des normes d'interopérabilité ouvertes pour la TV numérique interactive - y compris la norme MHP (Multimedia Home Platform ou plate-forme multimédia domestique) - de façon on obligatoire, a déclaré la Commission européenne dans une nouvelle communication à ce sujet. Il n'y a pas à l'heure actuelle d'argument irréfutable pour imposer des normes techniques, mais la question devra être réexaminée en 2005. Parmi les propositions faites par la Commission figurent la création d'un groupe d'Etats membres sur la mise en oeuvre de la norme MHP, la confirmation que les Etats membres peuvent allouer des subventions à la consommation - sous réserve de la réglementation en matière d'aides d'Etat - et la surveillance de l'accès aux applications propriétaires de la TV numérique interactive.

    [02] WTO Doha Development Agenda : WTO mid-point agreement paves the way for future conclusion of trade round - a stronger multilateral trading system

    Meeting in Geneva last week, the World Trade Organisation has taken a decision which effectively completes half of the trade negotiations launched in Doha in November 2001- the Doha Development Agenda (DDA). The text adopted on 31Â July sets the parameters of the future package in five key areas : agriculture, industrial products, development issues, trade facilitation, and services. To complete the Round, the framework needs to be filled out, notably with figures. The DDA is crucial to bolstering international economic growth and helping developing countries integrate into the global economy. The decision adopted today gives a clear signal that the multilateral trading system can deliver on the real needs of all its members, especially developing countries, and maintaining an ambitious round that is broad in scope.

    [03] Lancement de la consultation préparatoire au réexamen de la stratégie européenne en faveur du développement durable

    La Commission européenne a lancé une vaste consultation d'une durée de 12 semaines sur la stratégie européenne de développement durable. Les résultats de cette consultation constitueront une contribution importante pour le réexamen de la stratégie adoptée en 2001. Ce réexamen comportera une évaluation des progrès réalisés depuis 2001 et une feuille de route décrivant les actions nécessaires pour parvenir à un développement durable à long terme. La consultation recueillera les avis de la population, des parties prenantes et des spécialistes de terrain. Les contributions seront acceptées jusqu'au 31 octobre 2004.

    [04] European contract law : Commission invites stakeholders to participate in network

    The European Commission has issued an invitation to consumer organisations, lawyers, business groups and other stakeholders with an interest in the European contract law initiative to apply to join a new network it plans to create. The CFR-Net will bring together stakeholders and legal experts to assist the Commission in creating the 'Common Frame of Reference' foreseen the Commission's Action Plan on European Law, which sets out a road map for a more coherent approach to contract law by the EU (see IP/03/232). Contract law underpins all internal market transactions in Europe - whether it be businesses selling products or services to other businesses or purchases made by consumers. EU laws such as the Sale of Consumer Goods Directive or the Package Travel Directive already harmonise specific aspects of Member States' contract laws. The "Common Frame of Reference" (CFR) will provide common principles, definitions and model rules in order to improve existing and future EU legal rules on contract law. Initial preparatory work for the CFR will be undertaken by a group of academic lawyers. The role of the CFR-Net will be to ensure the outcome of this work addresses the real problems faced by stakeholders in a practical way. The Commission wants to see the network drawing on as wide a range as possible of different legal traditions and different economic interests across the EU, including industry, trade, the service sector, financial services, legal practitioners, notaries, judges, arbitrators and consumers associations.
