  • [01] Accises : la Commission propose d'harmoniser la fiscalité du gazole professionnel

    Afin de garantir une meilleure protection de l'environnement et de remédier aux importantes distorsions de concurrence qui existent, dans l'UE, sur les marchés libéralisés des transports routiers, la Commission européenne a présenté une proposition qui prévoit d'harmoniser progressivement les taux d'accises appliqués par les Etats membres sur le gazole professionnel et d'aligner les accises minimales sur le gazole non-professionnel et l'essence sans plomb. La proposition institue un taux pivot de 350 € pour 1.000 litres à partir du 1er janvier 2003, qui serait indexé sur l'inflation ; la marge de variation des Etats membres par rapport au taux pivot serait progressivement réduite de manière à aboutir à un taux unique harmonisé d'ici 2010. Par ailleurs, le taux d'accises minimal sur l'essence sans plomb serait appliqué, d'ici 2006, au gazole non-professionnel étant donné qu'une taxation plus basse du gazole - comme c'est le cas actuellement - ne se justifie pas du point de vue de la protection de l'environnement. En outre, la proposition prévoit de faire passer le taux minimal actuellement appliqué à l'essence sans plomb de 287 € (niveau actuel) à 360 € pour tenir compte de l'inflation. Lorsque le taux d'accises minimal sur le gazole professionnel dépassera 360 € dans le cadre de l'harmonisation progressive de la fiscalité, il devra également être appliqué au gazole non-professionnel et à l'essence sans plomb. Ainsi, le taux d'accises minimal sur le gazole non-professionnel et l'essence sans plomb ne sera jamais inférieur à celui appliqué sur le gazole professionnel et sera en permanence indexé sur l'inflation. L'approche commune relative à la fiscalité des accises sur le gazole utilisé par les transporteurs routiers et les autocaristes est l'un des objectifs énoncé dans le Livre blanc de la Commission sur la politique européenne des transports à l'horizon 2010 (voir IP/01/1263).

    [02] Commission clears Carnival's takeover bid for P&O Princess

    The European Commission has granted clearance under the European Union's Merger Regulation to the proposed acquisition of British cruise operator P&O Princess Plc by US-based cruise operator Carnival Corp. The Commission was initially concerned about the parties' strong position in the cruise market in the UK and in Germany. But after an in-depth analysis it concluded that the strong growth enjoyed in the market, the absence of substantial barriers to entry and the ability for rivals in the market to shift capacity, for example from the US to the UK, would exert a sufficient competitive pressure on Carnival.

    [03] Ecopoints : Commission again decides not to apply the 108% clause due to insufficient evidence

    The European Commission has decided not to apply a cutback in ecopoints for 2002 as a result of the number of lorry trips made through Austria in 2001 - as the so-called "108% clause" would require. Whilst initial statistics from Austria seemed to indicate that the 108% threshold had been exceeded in 2001, a closer examination cast doubt on this as no real evidence was provided of transit. The Commission will therefore be distributing the remaining ecopoints for 2002.

    [04] La production grecque de coton en 2001-2002

    Afin de déterminer la production de coton à prendre en compte en Grèce pour établir le prix minimal et l'aide pour la campagne actuelle 2001/2002, la Commission européenne a décidé de définir la notion de "production effective" de coton non égrené comme étant la production de coton réellement produite sur les superficies autorisées en ce qui concerne le régime d'aide. La production effective grecque de coton de la campagne 2001/2002 a été fixée à 1.246.838 tonnes, induisant une dépense de 571 millions d'€ et un prix minimal de 593 €/tonne.

    [05] €70 million proposed for additional aid to Afghanistan, raising EU support to €250 million in 2002

    An additional budget of €70 million in favour of Afghanistan is requested in a Supplementary and Amending Budget proposal, adopted on 24 July by the Commission. If Parliament and Council agree, these additional funds will contribute to support the new Afghan Transitional Authority in its efforts to build up a central administration, to fund Health and Social protection projects and to rebuild power and water infrastructures in Kabul. The EU is thus taking a further step to live up to its pledge of €1 billion over the period 2002-2006.

    [06] Statement by Romano Prodi, President of the European Commission

    The President of the European Commission, Romano Prodi, yesterday made the following statement : "The 'real economy' of the European Union is in good shape. Our companies are healthy, our key economic data are sound. The fundamentals are good. However, the unsettled state of financial and stock markets is a cause of concern. The problems of corporate governance in the USA are serious and require careful attention. In Europe, we must also pay attention to these issues. Rules for corporate governance and the authorities enforcing them serve us well. But they must be adapted to the scale of the European Union's internal market, soon to be enlarged to take in up to 10 more countries, and to the seriousness of the challenges facing us. My message is one of confidence : firstly in our economy's robust health and ability to sustain development and create employment and wealth ; secondly in the EU's policies and capacity to devise a strong legal framework for corporate governance."

    [07] Commission clears acquisition of Brake Bros by private equity firm CD&R

    The European Commission has cleared the acquisition by US-based private equity firm Clayton, Dubilier & Rice (CD&R) Fund VI of British food group Brake Bros Plc. CD&R is not presently active in any of Brake Bros's business areas and, therefore, the acquisition does not trigger any competition concerns.

    [08] Les organisations d'opérateurs oléicoles : un autre pas dans la mise en œuvre de la stratégie pour la qualité de l'huile d'olive

    La Commission européenne a adopté le règlement portant modalités d'application pour les programmes d'activités des organisations d'opérateurs oléicoles, fixant notamment les critères d'agrément de ces organisations ainsi que les activités finançables de leurs programmes. L'objectif est de permettre un engagement actif des opérateurs dans le devenir du secteur. Avec cette décision, la Commission a complété la mise en place de la stratégie pour la qualité de l'huile d'olive.

    [09] La reconnaissance mutuelle dans le domaine des produits et des services au sein du marché intérieur : bilan mixte

    Dans les domaines non harmonisés au niveau communautaire, le principe de la reconnaissance mutuelle implique qu'un Etat membre ne peut, en principe, interdire la vente sur son territoire d'un produit ou d'un service légalement fabriqué et/ou commercialisé dans un autre Etat membre, sauf dans des conditions très strictes. Même si ce principe est déjà bien appliqué pour les produits simples, beaucoup de progrès reste à faire en ce qui concerne les produits techniquement complexes ou qui peuvent poser des problèmes de sécurité ou de santé, ainsi que dans le domaine des services. Telle est la conclusion principale du deuxième rapport biennal publié par la Commission européenne aujourd'hui. Ce deuxième rapport biennal précise aussi que dans certains secteurs, l'harmonisation des réglementations nationales continuera à être la solution la plus appropriée. Comme conclusion au rapport, la Commission envisage d'adopter une communication aux Etats membres et aux opérateurs économiques, explicitant les droits et les obligations des parties concernées dans les cas où le principe de la reconnaissance mutuelle trouve à s'appliquer.

    [10] Result of the Standing Committee on the Food chain on MPA- contamination (24/07)

    The Netherlands and Belgium gave a detailed report on the situation in their respective country. They explained in detail the various traceability tracks they were investigating and the measures taken for each of them. Member States and the European Commission reiterated again the commitment to take joint actions to protect public health. The approach taken over the past days was re-confirmed (see IP/02/1065) : tracing, recalling, destroying and testing of potentially affected feed and food. Member States ensured that all measures were taken to protect public health.

    [11] Professional qualifications : Germany, Spain, Ireland, Italy, the Netherlands, Austria and the United Kingdom before the Court of Justice

    The Commission has decided to bring an action before the Court of Justice against seven Member States (Germany, Spain, Ireland, Italy, the Netherlands, Austria and the United Kingdom) for failure to notify it of measures transposing into their national law Directive 1999/42/EC on the recognition of professional qualification for certain industrial, commercial and craft occupations, such as electricians, itinerant tradesmen, tilers and hairdressers.

    [12] Marchés publics : la Commission poursuit une procédure d'infraction contre l'Espagne concernant une concession sur l'autoroute A6

    La Commission européenne a décidé de demander formellement à l'Espagne de modifier l'octroi d'une concession administrative pour la construction, le maintien et l'exploitation des deux connexions de l'autoroute A-6 avec Segovia et avec Ávila ainsi que pour le maintien et l'exploitation du tronçon Villaba-Adanero, sur la même autoroute. La concession attribuée comporte des éléments importants qui ne figuraient pas dans l'appel d'offres y référant. La demande formelle est sous forme d'un avis motivé, la deuxième étape de la procédure d'infraction selon l'article 226 du Traité. L'Espagne est tenue de répondre dans les deux mois de la réception de l'avis motivé. A défaut de réponse ou en cas de réponse insuffisante, la Commission peut décider de saisir la Cour de justice européenne.

    [13] Libre circulation des marchandises : procédures d'infraction contre la France, la Belgique et l'Autriche

    La Commission européenne a décidé de saisir la Cour de Justice européenne à l'encontre de la France en ce qui concerne sa réglementation excessivement lourde sur l'importation de médicaments pour usage personnel. Elle a également décidé de demander formellement à la France de mettre en conformité avec la législation européenne son droit national concernant l'emploi des langues pour l'étiquetage des denrées alimentaires. La Commission demande en outre à la Belgique de mettre fin à l'interdiction en région wallonne au commerce des oiseaux nés et élevés en captivité, y inclus des oiseaux légalement commercialisés dans un autre Etat membre. En ce qui concerne l'Autriche, la Commission a décidé d'inviter ce pays à lever son interdiction de vente à distance de compléments alimentaires ainsi qu'à mener ses procédures de contrôle pour la mise sur le marché de compléments alimentaires dans des délais raisonnables et connus aux tiers. Les demandes de la Commission seront adressées sous forme d'avis motivés, la deuxième étape de la procédure d'infraction prévue à l'article 226 du Traité CE. En l'absence d'une réponse satisfaisante dans les deux mois suivant la réception de l'avis motivé, la Commission pourrait décider de traduire les Etats membres concernés devant la Cour de Justice. Ce sont tous des cas de violation des règles du Traité CE qui interdisent toute entrave injustifiée ou disproportionnée à la libre circulation des marchandises (articles 28 à 30).

    [14] Commission makes good progress in programming aid with African, Caribbean and Pacific partners

    The European Commission has made good progress in the preparation of development cooperation strategies with many of the ACP (Africa, Caribbean and Pacific) countries which are signatories to the Cotonou Agreement. Over 60% of the Country Strategy Papers have so far been approved by Member States. Welcoming these developments, Commissioner for Development and Humanitarian Aid, Poul Nielson, said : "It is important to complete the programming process in order to step up the fight against poverty in some of the world's poorest countries. With the Cotonou Agreement and EU development policy, we are concentrating aid on a reduced number of sectors so as to have a stronger impact in the fight against poverty. I particularly welcome the spirit of partnership between the beneficiary countries and the Commission that has characterised this exercise."

    [15] Commission provides €3.8 million humanitarian aid package for Sri Lanka

    The European Commission has adopted a decision worth €3.8 million to provide humanitarian support for people going home in northern and north- eastern Sri Lanka. The main focus of the Commission's decision is to help returnees re-establish themselves in their home areas, where dwellings and infrastructures have been destroyed during almost two decades of war. The funding will cover the rehabilitation of houses, water supply networks and sanitation, agriculture inputs, and training in maintenance and hygiene. The decision also has a healthcare component aimed at improving the access of internally displaced people (IDPs) to basic medical services especially in returnee areas. After 19 years of fighting between Tamil separatists and government forces, a ceasefire was signed in February 2002. At any given time during the conflict, there were up to 800,000 IDPs originating mainly from the northern Jaffna peninsula and the neighbouring Vanni region. Although the peace is fragile, pending a full political settlement, an estimated 100,000 IDPs opted to return home during the first six months of 2002 and further returns are expected, if the ceasefire holds, from among the 700,000 people who remain displaced. The funds are being channelled through the Humanitarian Aid Office, which comes under the authority of Commissioner Poul Nielson.

    [16] Franz Fischler visits Japan : "Building on partnership for success"

    Opening the first stop of his five-day trip to Japan and Thailand, in Tokyo, European Commissioner Franz Fischler, responsible for agriculture, rural development and fisheries, today addressed the Japanese Federation of Agricultural Cooperatives, journalists and agri-business representatives in Tokyo, before meeting Japanese Minister for Foreign Affairs, Mrs Kawaguchi. Commenting to Mrs Kawaguchi on "the positive development of EU-Japan relations", Mr Fischler discussed the value of our bilateral cooperation within the WTO, his interest in building further on the existing close partnership, and the mid-term review of EU agricultural policy. "Japan and the EU have created a very close political and trade relationship over the last decade", he said, remarking that bilateral trade in particular had seen very "positive developments, rocketing by almost 50% in the last six years". Nevertheless, "Europe and Japan can substantially benefit from closer cooperation". Mr Fischler hopes that his bilateral meetings with the Japanese government during the course of his stay will help to foster this cooperation.

    [17] WTO highlights the EU's crucial role in the multilateral trading system

    Ahead of this week's review meeting in Geneva concerning developments in the EU's trade policy in the past two years, the WTO recognised the EU's leading role in the rules-based multilateral trading system and in building support for the launch of the Doha Development Agenda. The WTO also recognised the progress made on the internal economic integration front and the supportive role trade policy played in this respect by maintaining open markets, proceeding with WTO liberalisation commitments, and supporting further deepening of multilateral commitments.
