  • [01] Les nouvelles règles sur le contrôle des concentrations entrent en vigueur

    Les modifications du règlement sur les concentrations adoptées par le Conseil des Ministres en juin 1997 sont entrées en vigueur le 1er mars 1998. Les principaux changements visent à élargir le champ d'application du règlement à toute entreprise commune de plein exercice atteignant une dimension communautaire. D'autres modifications concernent des points de procédure, notamment afin d'éviter les notifications multiples à niveau national et de faciliter la notification à la Commission européenne. La Commission a aussi adopté des nouvelles communications interprétatives sur les notions d'entreprise commune, de concentration et d'entreprise concernée, ainsi que sur le calcul des chiffres d'affaires. Finalement la procédure pour les concentrations relevant du traité CECA sera alignée sur celle du règlement sur les concentrations.

    [02] Commission investigates Brazilian restrictions on EU textile exports

    The European Commission this week launched an investigation into obstacles to exports of European Union (EU) textile and clothing to Brazil. This new investigation adds to two other Commission actions currently underway against Brazilian obstacles to trade - in Cognac and flat steel products. The Commission's investigation follows a complaint lodged by FEBELTEX (Fédération Belge du Textile) under the Trade Barriers Regulation. FEBELTREX complained about Brazil's import licensing system for textile products, especially compulsory import payment terms and minimum import prices. FEBELTEX argues that, as a consequence of these obstacles to trade, exports to Brazil of certain textile products have come to an almost complete halt. The Commission believes these practices may also contravene Brazil's international obligations under several World Trade Organisation (WTO) Agreements. The EU has already requested consultations with Brazil in the WTO about the general import payment terms regime established by Brazilian legislation.
