The Court has condemned Turkey of human rights violations with regard to the peaceful enjoyment of ones possessions, as this is prescribed in the Protocol to the European Convention on Human Rights, of the Council of Europe.

The Court has reserved judgment as to the compensation to be paid to the applicants, four Greek Cypriots (Alexandrou, Solomonides, Gavriel, Orphanides).

In other cases the Court has dealt with, it found Turkey guilty of serious violations of the Convention.

In the case of Murat Celik v. Turkey, the Court held, unanimously, that there had been no violation of Article 3 concerning alleged ill-treatment and, by five votes to two, that there had been a violation of that Article concerning lack of effective investigation.

The applicant alleged that in February 1999 he was ill-treated by police officers. Celik was awarded 5,000 euro in respect of non-pecuniary damage and EUR 1,000 for costs and expenses.

In the case Elgay v. Turkey, the Court held unanimously that there had been a violation of Article 5 Paragraph 4 (right to liberty and security), on account of the lack of a domestic remedy by which Elgay could have challenged the lawfulness of his detention, and a further violation of Article 5 Paragraph 5 concerning the lack of an enforceable right to compensation for the breach of his right under Article 5 Paragraph 4.

The applicant, in July 2002, was arrested and detained on remand on suspicion of membership of an illegal organisation, the PKK (the Kurdistan Workers Party).

In the case Sedat Imza v. Turkey, the Court held unanimously that there had been a violation of Article 10 (freedom of expression), as the interference with the applicants freedom of expression had not been justified, particularly in the context of debate on an important matter of public interest.

The applicant is the owner and editor in chief of the magazine Ozgyrluk Dunyasi (World of Freedom). Relying on Article 10, he complained about his criminal conviction for having published statements made by the PKK (the Workers Party of Kurdistan) and the fact that, as a result, publication of his magazine had been suspended.

In the case of Mahmut Yaman, the Court held unanimously that there had been a violation of Articles 5 Paragraph 3 (right to liberty and security) and 6 Paragraph 1(right to a fair trial in a reasonable time), and awarded the applicant 11,000 Euro in respect of non-pecuniary damage.

In 1999, the applicant was remanded in custody in the framework of an anti-terrorist police operation, then kept in detention and charged with undermining the territorial integrity of the State. The criminal proceedings against him are still pending today.

Yaman was complaining about the excessive length more than 9 years of his detention pending trial and of the proceedings against him.

Finally, in the case of Abdulkadir Uslu, the Court held unanimously that there had been a violation of Article 8 (right to respect for private and family life) and that the finding of a violation in itself constituted sufficient just satisfaction for the non-pecuniary damage sustained by the applicant.

The applicant complained about the Turkish authorities refusal to provide him with a copy of the results of a medical examination he underwent in prison.

During her meeting with Lavrov, the Foreign Minister of Greece is expected to discuss, among other issues, the Cyprus question, the situation in the Middle East, bilateral relations between Greece-Russia, further development of economic cooperation between the two countries, especially in the energy sector, and the priorities of the Greek presidency of the OSCE.

Speaking at a press briefing, Giorgos Koumoutsakos, Greek Foreign Ministry Spokesman, said that the issue of Caucasus and European security will also be discussed during the meeting.

[03] AMBASSADOR PASSES AWAY

Epaminondas was scheduled to undergo an operation at King`s College hospital where he was admitted on Sunday.

He is survived by his wife and two daughters.
