  • [01] Justice civile : deux propositions de la Commission pour l'achèvement de l'espace européen de justice, tant pour les citoyens que pour les entreprises

    La Commission européenne a adopté deux nouvelles propositions de règlement touchant à la justice civile, l'une qui vise à faciliter le recouvrement des pensions alimentaires au sein de l'Union européenne et l'autre à moderniser les règles déterminant le droit applicable aux obligations contractuelles ("Rome I"). Ces propositions s'inscrivent très clairement dans le cadre du mandat politique reçu du Conseil européen à Tampere (1999) et du Programme de reconnaissance mutuelle adopté par le Conseil et la Commission, fin 2000, dont les objectifs ont été réaffirmés par le Programme de La Haye adopté par le Conseil européen en novembre 2004.

    [02] Budget 2006 : fostering growth and jobs

    In 2006, the biggest increase of funding from EU budget is for : competitiveness (+4.4%), cohesion (+4.5%) and "the EU as a global partner" (+9.5%) - these figures reflect EU priorities. Dalia Grybauskaitė, European Commissioner for Financial Programming and Budget, welcomes today the European Parliament’s adoption of the EU budget for next year. Payment appropriations in 2006 will amount to €111.9 billion, or 1.01% of GNI. Commitments appropriations are fixed at €121.2 billion or 1.09% of GNI.

    [03] Autorisation des médicaments : la Commission facilite la vie aux PME

    Il est désormais plus facile de commercialiser des médicaments nouveaux et innovants, ce qui ne peut qu'être bénéfique pour les patients. En vue d'encourager les petites et moyennes entreprises (PME) à introduire des demandes auprès de l'Agence européenne pour l'évaluation des médicaments (EMEA), la Commission européenne a décidé aujourd'hui d'importants reports et réductions de redevances pour un certain nombre de services de l'EMEA, tels que les conseils scientifiques. D'autres dispositions concernent l'aide administrative, notamment dans le domaine des traductions, ainsi que la mise en place, au sein de l'EMEA, d'un "guichet unique" exclusivement réservé aux PME. Ces mesures répondent à la nécessité d'accorder une attention particulière aux petites entreprises, dont beaucoup ne possèdent pas les ressources réglementaires, ni la stabilité financière requises pour appliquer la législation pharmaceutique de l'UE. Le règlement entrera en vigueur d'ici quelques jours, après sa publication au Journal officiel.

    [04] Better regulation : agreement on a streamlined Machinery Directive

    The European Commission has welcomed today's agreement in the European Parliament to streamline the Machinery Directive (98/37/EC). It covers anything from small consumer products such as handheld power tools, outboard engines to large professional products such as paper making machinery or tower cranes. They can circulate freely in the internal market as long as they respect the directive's essential health and safety requirements ensuring the protection of consumers and workers. The agreed text improves legal certainty by clarifying the directive's scope and meaning by removing ambiguities that have led to diverging interpretations. For example, there will be clearer borderlines to other directives such as the Lifts and Low Voltage Directives. Market surveillance and surveillance of product certification bodies is made more efficient by improved coordination at EU-level and monitoring at national level. The European Parliament's adoption of the 2nd Reading Opinion enables a 2nd Reading Agreement with the Council on a streamlined Machinery Directive.

    [05] Transport aérien : droits des personnes à mobilité réduite

    Ce matin, le Parlement européen a voté en faveur du projet de règlement concernant les droits des personnes à mobilité réduite lorsqu'elles font des voyages aériens. Jacques Barrot, vice-président de la Commission européenne en charge des transports, a déclaré : "Une fois adopté, ce règlement va améliorer radicalement la situation de nos concitoyens handicapés et à mobilité réduite. En effet, cette initiative tend à concrétiser, dans le transport aérien, la protection des droits des usagers ainsi que le principe majeur de notre politique européenne en faveur de la non-discrimination des personnes handicapées et ceux qui sont moins mobiles."

    [06] Transport durable : vers une tarification plus juste de l'usage des infrastructures

    Le Parlement européen a voté ce matin en faveur du nouveau cadre de tarification de l'usage des infrastructures routières que la Commission européenne avait proposé en juillet 2003. Ce vote devrait permettre l'adoption en deuxième lecture dans les prochaines semaines de la nouvelle directive "Eurovignette". Cette législation encouragera les Etats membres à introduire et à développer des péages et des redevances qui permettront d'améliorer la gestion du trafic des transports commerciaux, de réduire la pollution, et de rassembler des fonds pour investir dans les nouvelles infrastructures de transport. "Je me réjouis de l'adoption prochaine de la directive Eurovignette qui a fait l'objet d'âpres discussions entre les Etats membres. Avec la possibilité de faire varier les péages et d'instaurer des surpéages, ce nouveau cadre marque une étape importante vers une tarification plus équitable de l'usage des infrastructures de transport", a déclaré Jacques Barrot, vice-président de la Commission en charge des transports. "Cet accord devenait urgent pour contribuer à rééquilibrer la répartition du trafic de marchandises entre les différents modes de transports."

    [07] Commission presents blueprint to fight HIV/AIDS over the 2006-2009 period

    The European Commission today adopted a Communication on "combating HIV/AIDS within the European Union and in the neighbouring countries 2006- 2009". This follows up on the Commission working paper on a "Coordinated and integrated approach to combat HIV/AIDS" adopted in 2004. The need for intensified action is confirmed by the latest data on the epidemic released by the EuroHIV network in the run-up to the World AIDS Day on December 1st (see IP/05/1481). The Communication focuses on key issues such as the involvement of civil society : fostering dialogue with stakeholders such as patients, NGOs and the private sector is central to boosting the impact of any HIV/AIDS strategy. A stronger focus on prevention is also necessary, as contrary to some perceptions the epidemic is on the increase in Europe and basic messages on prevention need to be restated, especially among high risk groups and young people. The Communication also addresses issues including surveillance, treatment and research and details concrete projects in an Action Plan for the period 2006-09.

    [08] Opérations sur valeurs mobilières : rapport d'évaluation de la Commission sur la directive concernant le caractère définitif du règlement

    La Commission européenne a publié un rapport d'évaluation sur la directive concernant le caractère définitif du règlement (1998/26/EC), qui vise à réduire les risques résultant de la participation à des systèmes de paiement et de règlement des opérations sur titres, spécialement lorsqu'un participant à un tel système devient insolvable. Le rapport est basé sur les réponses des Etats membres à un long questionnaire et il sera présenté au Conseil et au Parlement européen. Il conclut que la directive fonctionne bien et que les Etats membres sont satisfaits des résultats obtenus. La directive améliore la protection contre les risques et accroît la sécurité juridique et la prévisibilité au bénéfice des participants au système, tant nationaux que transfrontaliers. Toutefois, en raison des développements techniques récents et de l'augmentation de l'activité transfrontalière, il est peut- être nécessaire de clarifier et de simplifier la directive, afin d’adapter la législation à l'évolution des marchés financiers. Le rapport identifie dix questions qu'il faudrait étudier pour voir si le fonctionnement de la directive ne pourrait pas être amélioré. Dans le courant de 2006, la Commission consultera les Etats membres, le secteur financier et les banques centrales sur ces questions.

    [09] Financial reporting : Commission welcomes Parliament's support for strengthened accounting rules and easing burdens on small companies

    The European Commission has welcomed the European Parliament's vote on 15 December 2005 to approve the proposal for a Directive amending the European Union's Accounting Directives. The amendments will bring improved disclosure by obliging listed EU companies to provide annually a corporate governance statement and providing more insight into the use of off-balance sheet arrangements and unusual transactions with related parties, such as the spouse of a board member. In addition, thresholds defining small and medium sized companies will be increased by 20%, which will help to reduce those companies' financial reporting burdens.

    [10] Commission clears acquisition of DNS by Arrow

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of sole control of DNSint.com AG, Fürstenfeldbruck (DNS) of Germany by Arrow Electronics, Inc., Melville, USA (Arrow) of the US. Arrow is a wholesale distributor of electronic components and computer products. The company's distribution network covers the Americas, Europe and the Asia Pacific region. DNS is a wholesale distributor of computer products in Europe. The operation was examined under the simplified merger review procedure.

    [11] Commission clears acquisition of Nextra by Crédit Agricole and Intesa

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of joint control of Nextra Investment Management SGR S.p.A (Nextra) of Italy by Credit Agricole S.A. (CA) of France and Banca Intesa S.p.A (Intesa) of Italy. CA is a French-based bank present worldwide in the banking and financial sector. Intesa is one of the main banking groups in Italy. It provides banking and financial services mainly in Italy and in Eastern Europe. Intesa's activities in the asset management market are carried out by its wholly owned subsidiary Nextra. The operation was examined under the simplified merger review procedure.

    [12] Commission opens in-depth investigation into Cargill's take-over of Degussa's food ingredients business

    The European Commission has opened an in-depth investigation under the EU Merger Regulation into the planned acquisition by the US-based Cargill group of the food ingredients business of the German company Degussa AG. The Commission's initial market investigation has found that the proposed acquisition may create competition problems in the markets for lecithin, a natural emulsifier primarily used in food production. The decision to open an in-depth inquiry does not prejudge the final result of the investigation. The Commission now has 90Â working days - until 3 May 2006 - to take a final decision on whether the concentration would significantly impede effective competition within the European Economic Area or a substantial part of it.

    [13] EU rules on aviation noise pollution : Commission takes Latvia to the Court

    The European Commission has decided to take Latvia to the Court of Justice for failing to transpose European legislation on the introduction of noise- related operating restrictions at EU airports. For a coherent approach to aviation noise reduction it is essential that Member States follow the European rules and procedures.

    [14] Commission sends reasoned opinion to Greece on Single European Sky legislation

    The European Commission has sent a reasoned opinion - the last step before a formal complaint to the Court of Justice is lodged - to Greece for failure to respect EU legislation on the establishment of a national supervisory authority in the context of the Single European Sky.

    [15] Tarification routière (Eurovignette) : la Commission envoie un avis motivé à Italie

    La Commission européenne a envoyé à un avis motivé – la dernière étape avant le dépôt d'une plainte officielle devant la Cour de justice – à l'Italie, pour non-respect de la législation européenne relative à la tarification routière. L'Italie pratique des remises excessivement élevées, qui peuvent aller jusqu'à 30% pour les usagers fréquents des autoroutes italiennes.

    [16] Accord UE-Maroc dans le domaine de l'aviation

    Le 14 décembre, à la veille de la Conférence de Marrakech sur la coopération Euroméditerranéenne sur les transports, le vice-président de la Commission européenne, Jacques Barrot, et le ministre marocain de l'Equipement et du Transport, Karim Ghellab, ont procédé au paraphe de l'accord global UE-Maroc dans le domaine de l'aviation. Cet accord aérien global remplacera les traités bilatéraux qui prévalent actuellement entre le Maroc et les Etats membres. Il prévoit non seulement une ouverture réciproque des marchés, mais aussi une coopération réglementaire dans les domaines de la sécurité, de la sûreté et de la gestion du trafic aérien. Il permettra de développer un marché bilatéral de 4,5 millions de passagers annuels dans des conditions harmonieuses et illustre bien le renforcement des relations euro- méditerranéennes dans le domaine de l'aviation.

    [17] Commission releases a further €20 million in humanitarian aid to support tsunami victims

    The European Commission has adopted a new humanitarian aid decision for €20 million to provide continuing support to victims of the Indian Ocean tsunami. This funding comes on top of €103 million already allocated in four previous decisions, most of which has already been spent. The Commission is thus fulfilling the pledge made by Commission President Barroso at the Jakarta conference in January 2005 to provide €123 million for humanitarian programmes in the tsunami-affected areas.

    [18] La Commission accorde une aide humanitaire de €2 millions aux victimes de tensions ethniques dans le nord du Kenya

    La Commission européenne a décidé d'accorder une aide humanitaire de €2 millions aux victimes de tensions ethniques dans le nord du Kenya. Jusqu'à 450.000 personnes bénéficieront des actions humanitaires qui seront ainsi financées pour améliorer leur situation. Il s'agit de couvrir les besoins en nourriture, eau et assainissement, et de protéger les personnes prises dans des affrontements ethniques. L'aide se traduira notamment par un soutien nutritionnel, par la réhabilitation de points de forage, de réservoirs d'eau, de puits de surface et d'enclos à bovins, et par la mise en place de centres de protection et de conseil.

    [19] Enlargement Commissioner Olli Rehn on the court case of Orhan Pamuk

    "It is not Orhan Pamuk who will stand trial tomorrow, but Turkey. This is a litmus test whether Turkey is seriously committed to the freedom of expression and reforms that enhance the rule of law and benefit all Turkish citizens. I expect Turkey to respect the European Convention of Human Rights and the Copenhagen political criteria of the European Union. This is an opportunity to set a positive precedent for the numerous other cases on free speech that are awaiting trial. Considering the number of recent prosecutions, it appears that the new Penal Code does not provide sufficient protection for the freedom of expression. The Commission expects that the Turkish Government will make it clear to the country's prosecutors and judges that Article 301 of the new Penal Code should be interpreted fully in line with the European Convention of Human Rights. In parallel, we expect the Government to close the loopholes in the Code itself that allow such restrictive interpretations on freedom of expression. The trial of a novelist who expressed a non-violent opinion casts a shadow over the accession negotiations between Turkey and the EU. Full implementation of the reforms will be the crucial foundation to facilitate progress in the accession negotiations."

    [20] La Commission présente une stratégie pour aider les pays en développement à mettre fin à la pénurie de professionnels de la santé

    La Commission européenne a adopté une stratégie pour lutter contre la pénurie de médecins et d'infirmiers, qui a atteint la cote d'alerte dans les pays africains les plus touchés par le sida, la tuberculose et le paludisme. Cette stratégie suit de près l'accord de l'Union européenne sur un consensus concernant la politique de développement et sur une stratégie pour l'Afrique, dans laquelle la Commission propose des mesures coordonnées de l'UE pour aider les pays en développement à mettre en place des systèmes de santé viables. Dans sa communication, la Commission propose à l'UE une réponse cohérente et coordonnée pour faire tomber un obstacle majeur à l'amélioration de la santé dans les pays en développement et démontre une fois encore son engagement en faveur des objectifs du millénaire pour le développement (OMD).

    [21] Third quarter of 2005 compared to third quarter 2004 : Euro-zone labour cost up by 2.2% ; EU25 up by 2.7%

    According to Eurostat, total hourly labour costs in the euro-zone rose at an annual rate of 2.2% in nominal terms in the third quarter of 2005, down from 2.5% in the second quarter. In the EU25 the annual rise was 2.7% in the third quarter of 2005, the same rate as in the previous quarter. The two main components of labour costs are wages and salaries and non-wage costs. In the euro-zone, wages and salaries grew at an annual rate of 2.1% in the third quarter of 2005, and non-wage costs by 2.7%, compared to 2.2% and 3.2% in the second quarter. In the EU25 wages and salaries rose by 2.5% and the non-wage component by 2.9%. In the previous quarter the corresponding rates were 2.8% and 2.5%. A breakdown by economic activity shows that in the euro-zone hourly labour costs rose by 2.5% in industry, by 2.1% in services and by 1.5% in construction in the third quarter of 2005. In the EU25, labour costs grew by 2.7% in industry, by 2.8% in services and by 2.0% in construction.

    Aujourd'hui, Mme Margot Wallström, vice-présidente de la Commission européenne, a annoncé qu'Europe Direct, le service d'information de la Commission destiné aux citoyens européens, a atteint son record absolu d'appels en recueillant sa 100.000ème demande en 2005. Cette question a été posée par une citoyenne polonaise, Mme Malgorzata Jagóra, qui a appelé Europe Direct au sujet des taxes d'importation sur le mobilier et de la libre circulation des marchandises. Au début du mois de décembre, la Commission a également lancé dans toute l'Europe une vaste campagne promotionnelle pour présenter Europe Direct au grand public.

    The European Commission has launched a call for proposals to host Europe Direct information outlets across the United Kingdom. The British public will get hands-on independent local information on how to best make use of their rights as EU citizens.

    [24] Tsunami one year on : joint initiative by EU Presidency and Commission

    As the anniversary of the Asian Tsunami approaches, the European Commission and the EU Presidency will host a high-level meeting with other international partners on 20 December. The aim of the meeting is to take stock of what has been achieved in relation to the enormity of the damages caused by the tsunami and the unprecedented levels of financial assistance pledged, to identify what lessons can be drawn, and to set out the next steps. The event will bring together representatives of the EU, the UN, the World Bank, and aid organisations including the International Red Cross. Representatives from the countries worst affected by the Tsunami will also be present. International Development Minister Gareth Thomas will attend for the British Presidency, and the European Commission will be represented by Commissioner for External Relations Benita Ferrero-Waldner and Commissioner for Development and Humanitarian Aid, Louis Michel. PRESS ADVISORY: Cameras wishing to film a "tour de table" at the beginning of the meeting should contact Tanja Gohlert on 02.2959577. A press conference will be held at 12h30 in the press room of the Commission. The day before, on 19th December, directors from the European Commission and the World Bank will give a technical briefing on progress so far in support to the Tsunami affected region at 13h00 in the press room of the Commission.
