  • [01] L'adoption de la directive anti-blanchiment portera un coup Ă la criminalitĂ© et au terrorisme

    La Commission européenne se réjouit de l'adoption définitive par le Conseil des ministres de l'Economie et des Finances de la troisième directive relative à la prévention de l'utilisation du système financier aux fins du blanchiment de capitaux et du financement du terrorisme. Cette directive s'applique au secteur financier et à d'autres secteurs-clés des services et elle couvre aussi tous les fournisseurs de marchandises, lorsque les paiements en espèces dépassent €15.000. Les personnes auxquelles s'applique la directive sont tenues de coopérer dans la lutte contre le blanchiment d'argent en prenant diverses mesures pour établir l'identité des clients, faire état de leurs soupçons et instituer des systèmes de prévention au sein de leur entreprise. La Commission a proposé cette directive le 30 juin 2004 (IP/04/832) et le Parlement européen l'a approuvée en mai 2005 (IP/05/616) sous une forme que le Conseil a à présent acceptée, sans qu'il soit nécessaire au Parlement ou au Conseil de procéder à une deuxième lecture.

    [02] Commission approves acquisition of British Vita by TPG IV

    The European Commission has cleared under the EU Merger Regulation the proposed acquisition of British Vita PLC, a manufacturer and supplier of polymer-based products for various end applications, by TPG IV, a US-based private equity fund. After examining the transaction, the Commission concluded that it would not significantly impede effective competition in the EEA or any substantial part of it and has therefore approved the concentration.

    [03] Commission clears acquisition of Euramax by Goldman Sachs

    The European Commission has granted clearance under the EU Merger Regulation to the acquisition of sole control of Euramax International, Inc. (Euramax) of the US by Goldman, Sachs & Co, a subsidiary of Goldman Sachs Group Inc., also of the US. Goldman Sachs is a global investment banking, securities and investment management firm. Euramax is active in the production of value-added aluminium, steel, vinyl and fibreglass products for the building, construction and car industries. The operation was examined under the simplified merger review procedure.

    [04] Cultural diversity : a major step towards the adoption of a UNESCO Convention

    The negotiation of a draft UNESCO Convention on cultural diversity was concluded successfully in Paris on June 3 2005. The third negotiating session adopted a revised draft Convention and recommended to the next UNESCO General Conference (October 2005) to adopt it. As per the mandate given by the Council in November 2004, the European Commission negotiated on behalf of the European Community. The revised draft Convention legitimises cultural policies and promotes international cooperation. It reaffirms the respect of international obligations whilst obliging Parties to take into account cultural diversity objectives when applying and interpreting all their international obligations, and when negotiating new international commitments. This is a first in international law.
