MIDDAY EXPRESSNews from the Press and Communication Directorate General's midday briefingNouvelles du rendez-vous de midi de la Direction Général Presse etbCommunication18/03/05[01] Commission approves acquisition of Teboil and Suomen Petrooli by LukoilThe European Commission has cleared under the EU Merger Regulation the proposed acquisition of two Finnish operators of petrol service stations OY Teboil Ab (Teboil) and Suomen Petrooli Oy (Suomen Petrooli) by the Russian oil company OAO Lukoil (Lukoil). After examining the operation, the Commission concluded that the transaction would not significantly impede effective competition in the EEA or any substantial part of it and has therefore approved the concentration.[02] Détachement des travailleurs : la Commission demande à la Grèce et aux Pays-Bas de mettre fin à des restrictions injustifiéesLa Commission européenne a décidé de demander formellement à la Grèce de modifier sa législation exigeant un permis de travail pour les travailleurs non-communautaires légalement employés par une entreprise communautaire qui souhaite les détacher pour prester un service à titre temporaire en Grèce. La demande de la Commission prend la forme d'un avis motivé, la deuxième étape de la procédure d'infraction prévue à l'article 226 du traité CE. En l'absence d'une réponse satisfaisante dans les deux mois, la Commission pourrait traduire la Grèce devant la Cour de Justice. La Commission a décidé de demander aux autorités néerlandaises, par le biais d'une lettre de mise en demeure - la première étape d'une procédure d'infraction - de lui transmettre leurs observations en ce qui concerne l'obligation des entreprises de services de certains nouveaux Etats membres d'obtenir au préalable un permis de travail pour le détachement de leurs travailleurs aux Pays-Bas.[03] Libre circulation des marchandises : de trop nombreuses infractions gênent la croissance économiqueLa libre circulation des marchandises signifie, pour l'essentiel, que les Etats membres doivent, en principe, accepter sur leur marché les marchandises produites et/ou commercialisées légalement dans un autre Etat membre. Certaines règles techniques nationales établies par les Etats membres portent toutefois atteinte à ce principe. Bien que bon nombre d'entre elles poursuivent des objectifs politiques légitimes, la Commission européenne peut engager une procédure d'infraction à l'encontre de l'Etat membre concerné, dès lors que la libre circulation des marchandises est menacée. Malgré les progrès réalisés dans la consolidation du marché intérieur, 146 procédures d'infraction pour violation du principe de la libre circulation des marchandises restaient en cours à la fin de l'année 2004.[04] Free movement of goods : Commission takes Germany to Court over garlic capsules and pharmaciesThe European Commission has decided to refer Germany to the European Court of Justice, firstly for consistently treating garlic preparations as medicines and secondly over its requirement that hospitals can only be supplied with medicines by pharmacies in the same city or district.[05] Second hand cars : Commission takes action against Czech barriers to tradeThe European Commission decided to send the Czech Republic a formal request for information concerning obstacles to the registration of imported second hand cars in the Czech Republic. The Commission has received complaints about the conditions imposed by Czech legislation on the registration of imported second hand cars which appear to be stricter than the conditions imposed on the re-registration of second hand cars already circulating in the Czech Republic and seem even to prohibit the registration of a certain category of imported used cars. The Commission is concerned that the Czech legislation may constitute an unnecessary and disproportionate barrier to the free movement of second hand cars in the Internal Market, in violation of the EC Treaty rules (Articles 28-30).[06] Première notification des données de déficit et de dette pour 2004 : déficit public de la zone euro et de l'UE25 respectivement à 2,7% et 2, 6% du PIB - dette publique à 71,3% et 63,8%En 2004, le déficit public s'est réduit par rapport à 2003, tant dans la zone euro que dans l'UE25, tandis que la dette publique a augmenté. Elles sont conformes aux décisions d'Eurostat, y compris la décision la plus récente sur le traitement des transferts du budget de l'UE aux Etats membres. Toutefois, en ce qui concerne certains Etats membres, Eurostat doit mener un examen complémentaire des données de déficit et de dette avant que les chiffres puissent être validés. Measures agreed by the broadcasting regulators include stepping up information exchange and cooperation to ensure that EU rules which guarantee freedom of the media on the one hand and prohibit broadcasts which contain an incitement to hatred on the other hand, are enforced swiftly, effectively and consistently. The case of the Al Manar and, more recently, Sahar 1 channels, prohibited by the French authorities for inciting racial hatred, illustrate the need to act in concert to combat racial and religious hatred both in Europe and in other parts of the world. The broadcasting regulators called on the Commission to take this issue into account when proposing a modernisation of the EU "Television without Frontiers" Directive later this year.[09] World Water Day (22 March) - Water is LifeThe international observance of 22 March as World Water Day is an initiative that grew out of the 1992 United National Conference on Environment and Development in Rio de Janeiro. Seule une personne sur quatre ayant voté pour a placé la Constitution au centre de sa décision.[13] Benita Ferrero-Waldner and Peter Mandelson to visit Moscow (21/03)The European Commissioners for External Relations and European Neighbourhood Policy, Benita Ferrero-Waldner and for Trade Peter Mandelson will visit Moscow on 21st March for bilateral talks with senior members of the Russian government, as well as members of the Duma, and industrialists. The chief objective of their visit is to accelerate progress in the current negotiations for a package of Road Maps to create four "common spaces", in the fields of the Economy, External Security, Freedom, Security and Justice and Education, Research and Culture. In particular, the two Commissioners will jointly meet the Minister of Industry and Energy, Viktor, Borisovich Krhristenko, to address outstanding issues in the Common Economic Space. The EU's objective remains the conclusion of a balanced package of all four road maps in time for the next EU Summit on 10th May.[14] EU Election Observation Mission to Ethiopia deployedThe European Commission has deployed an EU Election Observation Mission for federal and state parliamentary elections in Ethiopia. The Mission will be led by Ms Ana Gomes, Member of the European Parliament, who will travel to Addis Ababa this week to meet relevant stakeholders in the electoral process.[15] Invitation for public comment on working document on Directive 2004/39/EC on the markets in financial instruments (“MiFID”)This working document has been drawn up following technical advice given to the European Commission by the Committee of European Securities Regulators (CESR). Publication of the document is part of the open and transparent regulatory process the Commission follows for drawing up technical implementing measures in line with the procedures agreed to implement the March 2001 Stockholm European Council Resolution to improve decision-making concerning securities markets (see IP/02/195). Since this working document is not a formal Commission proposal, the period for the European Securities Committee to vote on the measures, and for the European Parliament to consider them, is not triggered at this stage. The document covers only part of the implementing measures that the Commission intends to adopt. It is limited to the measures that the Commission considers that are essential for the effective entry into force of the Directive. This working document is not a formal Commission proposal.
