[01] Fonds structurels : la Commission alloue plus de 8 milliards d'€ aux
programmes performants
La Commission européenne a alloué aujourd'hui un montant supplémentaire de
8,246 milliards d'€ aux programmes européens de développement régional et
social pour la période 2000-2006. Cette somme, qui correspond à 4% du
budget total des Fonds structurels pour les 15 Etats membres actuels de
l'Union, provient d'une réserve de performance à allouer en 2004 sur la
base des résultats des programmes. A l'aide de ces ressources, les Etats
membres et les régions pourront donner une impulsion nouvelle aux
investissements, à la croissance et à la création d'emplois.
[02] Fisheries : Commission proposes quotas for jointly managed stocks and
amended technical rules for haddock
The European Commission proposed today to amend a number of measures
adopted by the Council last December on fishing possibilities and
associated measures for 2004. It proposes the adoption of total allowable
catches for the stocks jointly managed by the European Union and Norway
following agreement between the two parties in January. On the basis of new
scientific data, the Commission proposes to amend the boundaries of the cod
protection area in the North Sea and to change the percentages of haddock
that can be caught by vessels not holding a special licence (see attached
maps). Fishing with pots and creels as well as for pelagic species (mid-
water) could be permitted in an area west of Scotland currently closed to
all fisheries to protect cod. Also proposed is that time spent by a vessel
subject to the days-out-of-port regime assisting another vessel in need of
emergency aid is not counted against the vessel's allocation. The aim of
the proposal is to introduce flexibility where necessary and better adapt
measures to the fisheries concerned.
[03] Electronic communications : Commission takes second legal step against
eight Member States for not adopting new privacy rules for digital networks
and services
The European Commission has taken the second step in infringement
proceedings against eight Member States for failing to notify it of
measures transposing the Directive on Privacy and Electronic Communications
(e-Privacy Directive) into their national laws. The Directive governs areas
like "spam" e-mail and identifier "cookies". These proceedings were opened
against nine Member States in November 2003 (see IP/03/1663), but Sweden
has since notified the Commission of new spam legislation. The second stage
in infringement proceedings involves sending reasoned opinions to Belgium,
Germany, Greece, France, Luxembourg, the Netherlands, Portugal and Finland.
They now have two months in which to respond and could face action before
the European Court of Justice if they fail to comply.
[04] Libre circulation des biens : la Commission engage des actions à
l'encontre de la Grèce, de la Belgique et de l'Espagne
La Commission européenne a formellement demandé à la Grèce de lever
l'interdiction qui frappe l'installation et l'exploitation des jeux
électriques, électromécaniques et électroniques, y compris des jeux
informatiques, dans l'ensemble des lieux publics et privés, y compris les
locaux qui proposent des services internet (cybercafés). La Commission
estime que la loi concernée (du 29 juillet 2002) est incompatible avec les
dispositions du traité CE sur la libre circulation des biens et des
services et sur la liberté d'établissement. La Commission a par ailleurs
demandé à la Belgique de modifier sa législation relative aux dimensions
des contenants pour produits préemballés qui empêche la vente dans le pays
de certains produits provenant d'autres Etats membres, ainsi que de
modifier le régime discriminatoire en vigueur dans la région flamande qui
impose des droits de distribution sur l'électricité dite "verte" produite à
partir de sources d'énergie renouvelables dans d'autres Etats membres sans
imposer les mêmes droits à l'électricité "verte" produite dans le pays. La
Commission a finalement demandé à l'Espagne de modifier les obligations
d'étiquetage détaillé qu'elle impose aux produits textiles et qui
engendrent des coûts supplémentaires non justifiés pour ce type de produits
quand ils sont importés en Espagne par d'autres Etats membres de l'UE. Ces
demandes de la Commission prennent la forme "d'avis motivés", qui
constituent qui la deuxième étape des procédures d'infraction en vertu de
l'article 226 du traité CE. En l'absence de réponse satisfaisante dans un
délai de deux mois, la Commission peut renvoyer les Etats membres concernés
devant la Cour de justice européenne.
[05] Professional qualifications : Commission asks Greece to implement
European law
The European Commission has decided to make a formal request to Greece for
information on the measures taken to implement at national level the
Directive on the general system for the recognition of professional
qualifications concerning doctors, dentists, veterinary surgeons and
architects (Directive2001/19/EC). When the Directive was adopted, the
European Parliament and the Council of Ministers set 1 January 2003 as the
deadline for its implementation into national law. The Commission's request
takes the form of a reasoned opinion, which is the second stage of the
infringement proceedings laid down in Article 226 of the Treaty. If there
is no satisfactory reply, the Commission may refer Greece to the European
Court of Justice.
[06] La Commission traduit l'Italie devant la Cour de justice afin
d'empêcher qu'une installation hydroélectrique n'endommage des habitats
fluviaux
La Commission européenne a décidé de traduire l'Italie devant la Cour de
justice européenne en raison d'un projet hydroélectrique en Lombardie
prévoyant le captage d'eaux provenant du Schiesone (cours d'eau de la
province de Sondrio). La Commission craint que ce projet détériore
d'importants habitats fluviaux dans un site soumis à une protection
spéciale en vertu de la directive "Habitats". Des espèces comme la loutre
et le crapaud à ventre jaune vivent dans cette zone et risquent, comme
l'habitat lui-même, d'être menacés par la construction de la centrale, qui
réduirait la quantité d'eau dans la rivière. En 2003, les autorités
italiennes ont fait part à la Commission de mesures techniques visant à
réduire les effets négatifs sur les habitats fluviaux, mais le décret
régional présentant ces mesures a été annulé par une cour administrative
italienne en février 2004. Les travaux de construction se poursuivent et le
risque de dommages environnementaux irréparables est important.
[07] Commission warns Greece about exclusive rights granted to PPC for
electricity production based on lignite
The European Commission has warned Greece that the exclusive rights granted
to state-owned power supplier PCC for the mining of lignite, which accounts
for most of the electricity produced in the country, may be in breach of
European competition rules and in particular of Article 86 of the EU
Treaty. The Greek government has two months to justify or put an end to the
exclusive rights, which protect the de facto monopoly of PPC thereby
distorting competition three years after the electricity market was
supposed to be liberalised.

s'est élevé à 8,8% en février 2004, stable par rapport au mois de janvier
2004, selon les données publiées aujourd'hui par Eurostat. Il était de 8,7%
en février 2003. Le taux de chômage de l'UE15 s'est élevé à 8,0% en février
2004, inchangé par rapport à janvier 2004. Il était également de 8,0% en
février 2003. En février 2004, les taux les plus bas ont été enregistrés au
Luxembourg (4,0%), en Autriche (4,4%), en Irlande (4,5%) et aux Pays-Bas (4,
5% en janvier 2004). Le taux de chômage de l'Espagne (11,2%) est resté le
plus élevé de l'UE.
[09] EU-fYROM : Stabilisation and Association Agreement enters into force
The Stabilisation and Association Agreement (SAA) between the European
Union and the former Yugoslav Republic of Macedonia (fYROM) signed in April
2001 enters into force on 1 April 2004, taking the country another step
forward on the road to European integration. This is the first
Stabilisation and Association Agreement to enter into force. The Agreement
commits the parties to further work on political, economic and
institutional stabilisation of the country, institution building and public
administration reform, enhanced trade and economic cooperation, legal
approximation with the Community acquis and strengthened cooperation on
justice and home affairs. The full implementation of the Agreement will
also create a new climate for the development of trade and investment which
are crucial factors for the economic restructuring and the modernisation of
the country.
