[01] Nouvelles mesures pour protéger nos côtes : la fin des pétroliers à
simple coque est en vue
Aucun pétrolier à simple coque ne sera autorisé à transporter du fioul
lourd dans les eaux de l'Union européenne une fois que la proposition
présentée aujourd'hui par la Commission européenne aura été adoptée par le
Conseil et le Parlement. En outre, tous les pétroliers à simple coque du
type de l'Erika et du Prestige âgés de plus de 23 ans seront immédiatement
bannis des ports de l'Union, alors que l'élimination de navires plus
récents aura lieu plus tôt, à savoir entre 2005 et 2010 en vertu d'un
calendrier plus rigoureux que celui prévu par les règles en vigueur. Enfin,
pendant la période d'élimination progressive, les pétroliers qui n'ont pas
encore atteint l'âge limite seront soumis à des contrôles de sécurité plus
stricts. "Nous avons fait une première proposition de ce type au lendemain
du naufrage de l'Erika en décembre 1999", déclare Loyola de Palacio, vice-
présidente chargée des Transports et de l'Energie. "La catastrophe causée
par le Prestige montre clairement que les règles adoptées alors à l'issue
d'un compromis n'étaient pas assez ambitieuses. Ceci va changer", a-t-elle
ajouté. "J'espère que les mesures que nous proposons aujourd'hui entreront
rapidement en vigueur, afin que les menaces qui pèsent sur notre
environnement maritime et côtier soient radicalement et promptement
réduites." Le Prestige, un pétrolier à simple coque de 26 ans qui
transportait 77.000 tonnes de fioul lourd, a coulé au large des côtes de la
Galice le 18 novembre, causant une marée noire qui a atteint le littoral et
provoqué une catastrophe économique et environnementale majeure dans cette
région.
[02] Commission appeals CFI ruling on Tetra Laval/Sidel to the European
Court of Justice
On the basis of a proposal of European Commission President Romano Prodi
and in agreement with Competition Commissioner Mario Monti, the Commission
has decided to appeal to the European Court of Justice (ECJ) against the
annulment by the Court of First Instance (CFI) of its decision prohibiting
the acquisition of French plastic packaging machines maker Sidel by Swiss-
Swedish carton packaging leader Tetra Laval.
[03] Commission opens proceedings into joint selling of media rights to the
English Premier League
The European Commission has sent a Statement of Objections to the English
Football Association Premier League (FAPL) over the joint selling of the
media rights to Premier League matches. Joint selling is tantamount to
price-fixing, which could only be exempted if the restrictions of
competition were strictly necessary to ensure the legitimate goals pursued
by the arrangements for example solidarity among clubs - and if they
resulted in benefits for other interested parties, in particular football
fans. These same considerations have led the Commission in June to reach a
preliminary positive view on the modified rules of UEFA for the joint
selling of the media rights to the final stages of the Champions League.
[04] Commission clears acquisition of German brewery Brauergilde by
Interbrew
The European Commission has cleared under the Merger Regulation the
acquisition of German brewer Brauergilde Hannover S.A. by Interbrew S.A. of
Belgium. The transaction does not give rise to competitive concerns in any
beer market in the European Union.
[05] Commission clears acquisition of Kraftwerke Laufenburg by EnBW
The European Commission has authorised the acquisition of Swiss electricity
supplier Kraftwerke Laufenburg AG by German rival Energie Baden-Württemberg
AG (EnBW). The operation leads only to very minor overlaps, which do not
trigger any significant competition concerns.
[06] Commission clears acquisition of German bathroom fittings maker
Hansgrohe by Masco
The European Commission has cleared the acquisition of German bathroom
products producer Hansgrohe AG by US-based global consumer product
manufacturer Masco Corporation.
[07] Commission clears joint venture between Linde and Komatsu
The European Commission has authorised the acquisition by Linde AG and
Komatsu Ltd. of joint control over Komatsu Forklif Co. Ltd, currently a
wholly owned subsidiary of Komatsu Ltd., active in the manufacture and sale
of material-handling equipment.
[08] La Commission autorise Cargill à acquérir Associated Oil Packers
La Commission européenne a donné son feu vert au projet d'acquisition de la
totalité des actions de l'entreprise belge de conditionnement des huiles
végétales alimentaires Associated Oil Packers bvba (AOP) par la société
américaine Cargill Inc. AOP est actuellement une entreprise commune 50/50
entre Cargill et la société belge Vandemoortele n.v. L'opération
n'apportera aucune modification significative à la situation
concurrentielle présente du marché.
[09] Commission clears creation of two joint ventures by Linde and
Sonatrach
The European Commission has approved the creation of two joint ventures, by
Linde and Sonatrach, to be active in helium production and wholesale
supply.
[10] La Commission autorise l'acquisition d'une partie du groupe chimique
français Rhodia par le fonds d'investissement américain Bain Capital
La Commission européenne a donné son feu vert au rachat par Bain Capital
Ltd des activités européennes du groupe Rhodia dans le domaine de la chimie
intermédiaire. L'opération ne soulève pas de problèmes de concurrence,
étant donné que l'acquéreur n'exerce aucune des activités qu'il rachète.
[11] Commission clears acquisition of Belgium's Ontex by Candover
The European Commission has granted clearance under the Merger Regulation
to the acquisition of sole control of the Belgian hygiene products maker
Ontex NV by British fund managers Candover Partners Limited. (The operation
was examined under the simplified merger review procedure).
[12] Commission clears acquisition of Spanish retailer El Arbol by CVC
The European Commission has granted clearance under the Merger Regulation
to the acquisition of full control of Spanish retailer Grupo El Arbol
Distribución y Supermercados S.A.U., currently controlled by Laurus
Luxembourg SQRL, by British investment company CVC Capital Partners Group
Ltd. (The operation, notified on 21 November 2002, was examined under the
simplified merger review procedure).
[13] Budget UE 2003 : assurer le respect de la discipline budgétaire tout
en faisant face aux nouvelles priorités
Le Parlement européen a adopté le 19 décembre, à une majorité écrasante, le
budget 2003 de l'UE, qui représente un volume de 99.685 millions d'€s en
crédits d'engagement, soit une augmentation d'à peine 0,26% par rapport au
budget 2002. Les dépenses s'établiront à seulement 1,02% du revenu national
brut communautaire (RNB). Mme Michaele Schreyer, Membre de la Commission
européenne chargé du budget, a salué l'excellente coopération avec le
Parlement européen ainsi que le résultat atteint : "Le budget 2003 est le
dernier de l'Union à quinze. Il combine discipline budgétaire et définition
de priorités claires, en particulier la préparation des institutions de
l'UE à l'élargissement."
[14] Commission proposes daily fines on Ireland to ensure adequate
protection of sensitive peatlands from peat extraction
The European Commission has decided to refer Ireland to the European Court
of Justice for the second time in order to enforce a previous judgement of
the Court handed down in September 1999. The Commission also decided to
propose to the Court that daily fines of €21,600 be imposed on Ireland.
These fines would apply from the day of the second judgement of the Court.
The case concerns non-compliance by Ireland with the Environmental Impact
Assessment Directive with regard to peat extraction. The Directive sets out
a procedure for assessing in advance the likely impacts of environmentally
significant projects. This EU law has an important role to play in helping
to ensure that Irish peatlands of conservation importance are properly
safeguarded from the damage that can result from drainage and mining
associated with peat extraction. Hosting rare plants and animals, those
Irish peatlands that are of conservation importance form a valuable
component of global biodiversity.
[15] Premières estimations pour octobre, données révisées pour septembre :
excédent de 8,7 milliards d'€ du commerce extérieur pour la zone euro en
octobre 2002 ; excédent de 0,2 milliard d'€ pour l'UE15
D'après les premières estimations publiées aujourd'hui par Eurostat, pour
le mois d'octobre 2002, la zone euro a enregistré un excédent du commerce
extérieur de 8,7 milliards d'€ avec le reste du monde, comparé à +10,1
milliards en octobre 2001. Le solde (révisé) enregistré au mois de
septembre 2002 était de +9,0 milliards, comparé à +4,5 milliards en
septembre 2001. La zone euro a enregistré un excédent du commerce extérieur
de 84,9 milliards pour les dix premiers mois de 2002, comparé à +34,4
milliards en 2001.
[16] La Commission intensifie ses efforts pour venir en aide aux pêcheurs
et aux aquaculteurs touchés par la marée noire du "Prestige"
La Commission européenne a présenté le 19 décembre une proposition de
mesures spécifiques destinées à indemniser les opérateurs du secteur
espagnol de la pêche, de la conchyliculture et de l'aquaculture frappés par
la marée noire consécutive au naufrage du pétrolier "Prestige" au large des
côtes de Galice le 22 novembre. M. Franz Fischler, membre de la Commission
chargé de la pêche, a déclaré à ce propos : "Les informations qui
continuent à nous parvenir au sujet de la marée noire consécutive au
naufrage du "Prestige" sur les côtes de l'Espagne, et l'ampleur qu'est en
train de prendre ce désastre écologique nous touchent de très près. J'ai
affirmé d'emblée que l'UE ferait son travail et témoignerait de sa
solidarité avec ceux qui ont été si durement frappés. C'est pourquoi je
suis heureux que nous soyons aujourd'hui en mesure de mettre une aide
financière d'un montant de 30 millions d'€ à la disposition des pêcheurs et
des aquaculteurs sinistrés." Face à la gravité exceptionnelle des dommages
causés par cette marée noire, une indemnisation qui actuellement ne peut
être octroyée qu'aux pêcheurs et aux propriétaires de navires selon les
règles de l'IFOP (instrument financier d'orientation de la pêche) pourra
l'être également aux conchyliculteurs et aux aquaculteurs pour la cessation
de leurs activités. Une aide sera également consentie afin de permettre à
la profession de remplacer les engins de pêche et les stocks endommagés, et
de nettoyer, réparer et reconstruire les sites d'aquaculture. Pour ce faire,
la Commission propose deux mesures : adapter un certain nombre de
dispositions de l'IFOP afin que l'Espagne puisse apporter une aide
financière au secteur; et permettre à l'Espagne de réaffecter un montant de
quelque 30 millions d'€ alloués à la reconversion de la flotte espagnole
pratiquant auparavant la pêche au titre de l'accord conclu entre l'UE et le
Maroc, et restés inemployés. Qui plus est, un montant estimé à 80 millions
d'€ pourrait faire l'objet d'une reprogrammation sur la part de l'Espagne
dans l'IFOP. Le Parlement européen a voté hier unanimement en faveur de la
proposition de la Commission.
[17] Solidarity Fund : €129 million transferred to the Czech Republic after
the disastrous flooding
Michel Barnier, European Commissioner for regional policy, and Bohuslav
Sobotka, the Czech Minister of Finance, have signed an agreement involving
€129 million in assistance for the regions affected by the floods last
August. This is one of the first four aid packages paid for out of the
European Union Solidarity Fund. This Fund, proposed by the Commission in
September, has been set up within three months with a view to providing
quick EU emergency assistance after major disasters. The sums being
allocated to the Czech Republic are to serve, among other things, for
reimbursing expenditure on aid operations, immediately securing flood-
protection facilities, repairing waste-water facilities, restoring energy
and drinking-water supplies as well as transport infrastructure
[18] Turkey : Commission approves €126 million programme for Turkey
The European Commission today approved its 2002 pre-accession financial
assistance programme for Turkey. €126 million has been provided for 18
different projects designed by Turkey to help it prepare to take on the
obligations of EU membership. In implementing the programme, officials from
the EU member states will, for the first time, be seconded to Turkish
ministries to offer on-the-spot expertise. This extends to Turkey the
highly successful practice of "twinning" already in place for the other
twelve candidate countries.
[19] La Commission adopte cinq nouvelles décisions d'aide humanitaire pour
un montant dépassant 5,6 millions d'€
La Commission européenne a récemment adopté des décisions humanitaires
concernant la Côte d'Ivoire (1,5 million d'€), la Géorgie (1,3 million d'€),
l'Arménie (0,5 millions d'€), le Sénégal (0,75 million d'€) et la Thaïlande
(1,565 million d'€). L'aide est acheminée par l'Office d'aide humanitaire
(ECHO), qui relève du commissaire Poul Nielson.
[20] Commission allocates humanitarian aid of €3 million for drought-
victims in India
The European Commission has adopted a humanitarian aid decision worth €3
million to help victims of the drought that has hit Rahjastan in India. The
funds are being channelled through the Humanitarian Aid Office (ECHO),
which comes under the responsibility of Commissioner Poul Nielson. The
money will serve to provide drinking water and food for the beneficiaries.
[21] EU implements Kimberley Scheme to block blood diamonds
European Commissioners for External Relations Chris Patten and Trade Pascal
Lamy welcome the adoption today by the Council of the EU Regulation, on a
proposal from the Commission, whereby the EU implements the Kimberley
Process Certification Scheme for the international trade in rough diamonds.
Mr Patten noted that "this regulation, will contribute to preventing the
use of diamonds to finance bloody wars in Africa. Depriving those who have
thrived on this trade of their income should help to remove the incentives
that have driven so many savage conflicts." Mr Lamy added that "the
adoption of this regulation is a clear signal that carefully drafted trade
measures can support the pursuit of development. Consumers buying diamonds
will be able to rely on a system of certifications and controls by the
national authorities, coupled with sanctions for the traders who do not
respect the scheme. This ensures that consumers will not unknowingly
contribute to the continuation of hideous wars. Today we are making sure
that diamonds are no longer the warlord's best friends."
[22] Two Commission disciplinary decisions in the "Stockholm case"
The European Commission has now concluded two of the three pending
disciplinary procedures concerning EU officials relating to the
irregularities which took place in its Stockholm Representation. The former
Head of the Representation, Ms Linda Corugedo-Steneberg, has received a
"written warning". The former Deputy-Head, Mr Sven-Olov Carlsson, has
received a "deferment of advancement to a higher (salary) step" for a
period of one year. Disciplinary proceedings against a former Commission
official had to be suspended pending the results of a criminal procedure in
Sweden.
