[01] Commission files civil money laundering action against R. J. Reynolds
The European Commission has filed a civil action on behalf of the European
Community (EC) and ten Member States against the U.S. cigarette
manufacturer R. J. Reynolds, following the dismissal of its cigarette
smuggling action last February. The following Member States participate in
the civil action : Italy, Germany, France, Spain, Portugal, Greece, Belgium,
The Netherlands, Finland and Luxembourg. The purpose of this new claim is
to obtain injunctive relief to stop the laundering of the proceeds of
illegal activities and to seek compensation for losses sustained.
"Protecting the financial interests of the European Community and fighting
against money laundering and fraud remains a top priority for the European
Commission", said Budget Commissioner Michaele Schreyer. "The Commission is
determined to win its fight against money laundering, cigarette smuggling
and connected serious cross-border crimes."
[02] Lettre rectificative au budget 2003 : des besoins moins importants que
prévu dans le secteur agricole
Comme en octobre de l'année passée, la Commission européenne a décidé de
saisir l'autorité budgétaire d'une lettre rectificative au budget 2003 afin
d'actualiser les dépenses agricoles et les estimations relatives aux
accords de pêche. Malgré un euro plus fort, les besoins budgétaires de
l'agriculture en 2003 devraient être inférieurs de 337 millions d'€ par
rapport au chiffre prévu initialement. Cette économie s'explique
essentiellement par les avances d'aides directes accordées aux producteurs
de céréales, s'élevant à 974 millions d'€, déjà payées en 2002. Les besoins
budgétaires pour l'agriculture devraient se situer à hauteur de 2,6
milliards d'€ sous le plafond des perspectives financières en 2003. Les
dépenses au titre du budget agricole 2002 seront donc cette année moins
élevées que prévu. Une estimation prudente de cet excédent sera budgétisée
en 2003, ce qui signifie que les recettes exigées de la part des Etats
membres en 2003 peuvent d'ores et déjà être réduites à hauteur de 500
millions d'€.
[03] Commission finds €15.7 million in aid to German porcelain manufacturer
Kahla illegal
The European Commission has examined a number of support measures in favour
of German porcelan maker Kahla Porzellan GmbH and its legal successor
Kahla/Thüringen Porzellan GmbH during the last decade. It concluded that
while an amount of €63.3 million either did not contain subsidies or they
were legal, a further amount of €15.7 million presented no valid
justification under the European Union state aid rules and must be
recovered.
[04] Commission approves German 'on-board' training aid of €4 million in
favour of maritime seafarers
The European Commission has given the go-ahead to a German maritime
training aid for 2002, as it has already approved in the past similar
German schemes for respectively 1998, 1999, 2000 and 2001. The aid regime
will help preserve maritime know-how and expertise on board German merchant
ships.

[05] Protection des données au travail: la Commission propose un nouveau
cadre aux partenaires sociaux européens
La Commission européenne a lancé aujourd'hui une deuxième phase de
consultation formelle des partenaires sociaux concernant une initiative
visant à améliorer la protection des données à caractère personnel des
travailleurs dans toute l'Union européenne. La Commission propose aux
organisations européennes de partenaires sociaux (dont l'UNICE, la CES,
l'UEAPME, la CEC et Eurocadres) un ensemble de principes et de règles
régissant le traitement des données à caractère personnel au travail afin
de fournir aux employeurs et aux travailleurs une orientation claire et
complète en ce qui concerne leurs droits et obligations dans ce domaine. La
décision de la Commission couvre une série de questions spécifiques liées à
la protection des données sur le lieu de travail, qui ont été posées pour
la première fois en août 2001, lors de la première consultation des
partenaires sociaux par la Commission sur le sujet, et qui comprennent le
traitement des informations sensibles, telles que celles relatives à la
santé, aux tests de consommation de drogues et aux tests génétiques et à la
surveillance de l'utilisation du courrier électronique et d'Internet par
les travailleurs. Dans le prolongement de cette consultation organisée par
la Commission, les partenaires sociaux disposent à présent d'une période
indicative de six semaines pour formuler des remarques sur les propositions
de la Commission ou pour décider éventuellement de prendre les choses en
main eux-mêmes, indépendamment de la Commission, afin d'élaborer leur
propre initiative à l'échelle européenne dans ce domaine.
[06] La Commission autorise la création d'une entreprise commune entre SNPE
et MBDA dans le secteur des moteurs de roquette à combustible solide
destinés aux armes tactiques
La Commission européenne a autorisé le projet de création d'une entreprise
commune entre la société française SNPE et la société aérospatiale et de
défense européenne MBDA. L'entreprise commune regroupera les activités
respectives de SNPE et de MBDA dans le secteur des moteurs de roquette à
combustible solide destinés à des systèmes d'armes tactiques. Compte tenu
du caractère limité des chevauchements d'activités et de la présence
d'autres concurrents puissants, la Commission estime que cette opération ne
soulèvera pas de problèmes de concurrence dans l'Union européenne.
[07] Commission clears joint venture between Sumitomo and Takeda
The European Commission has granted clearance under the Merger Regulation
to the creation of a joint venture between Japan-based companies Sumitomo
Chemical Co. Ltd. and Takeda Chemical Industries Ltd. The joint venture
will be active in the manufacture and sale of agricultural chemicals. (The
operation, notified on 27 September 2002, was examined under the simplified
merger review procedure)
[08] Commission clears acquisition of Telespazio by Finmeccanica
The European Commission has granted clearance under the Merger Regulation
to the acquisition by Finmeccanica S.p.A. of Telespazio S.p.A, an Italian
company currently controlled by Telecom Italia. (The operation, notified on
27 September 2002, was examined under the simplified merger review
procedure)
[09] Commission clears Post Danmark stake in Internet company e-Boks
The European Commission has granted clearance under the Merger Regulation
to a proposed operation by which Danish state-owned firm Post Danmark
acquires joint control of the e-Boks joint venture currently controlled by
Dmdata A/S and Kommunedata A/S. E-Boks is an Internet company, which has
established a safe infrastructure for sending, receiving and storing
electronic documents and mail. (The operation, notified on 30 September
2002, was examined under the simplified merger review procedure)
[10] Flash estimate - October 2002- Euro-zone inflation estimated at 2.2%
Euro-zone annual inflation is expected to be 2.2% in October 2002, up from
2.1% in September 2002, according to a flash estimate issued today by
Eurostat.

euro et de 2,1% dans l'UE15 au mois d'août 2002, par rapport à août 2001,
selon les estimations publiées aujourd'hui par Eurostat. Par rapport au
mois de juillet 2002, les ventes ont augmenté de 0,8% dans la zone euro et
de 0,5% dans l'UE15.
[12] October 2002 - Economic sentiment remained unchanged in the EU
The economic sentiment indicator remained unchanged in the EU in October
2002 reaching a value of 99.2. In the euro area, the indicator decreased
marginally by 0.1 percentage points, from 99.0 in September to 98.9 in
October. The economic sentiment indicator rose in Denmark (0.5 percentage
points), Ireland, Austria and United Kingdom (0.4 percentage points), and
Greece (0.3 percentage points), while it remained unchanged in Spain and
France. The indicator decreased in the Netherlands (0.7), Portugal (0.5),
Italy, Sweden (0.3) and Belgium (0.2), and to a lesser extent in Germany

[13] October 2002 - The Business Climate Indicator for the euro area
slightly increased in October
The Business Climate Indicator (BCI) for the euro area increased by 0.07
percentage points between September and October, reaching a value of -0.42.
Although the overall path has recorded a downward trend during the summer
period, the slight increase observed over the last two months might lead to
a more optimistic assessment of the current economic situation. This
increase was mainly driven by an improvement in order books, including
export order books, as well as in opinions about production expectations,
accompanied by a decrease in stocks of finished products. However,
production trends in the recent past pointed to a worsening. Full document

[14] Les nouvelles dispositions en matière de lutte contre la peste porcine
classique contribuent à la viabilité économique de l'élevage des porcins et
améliorent le niveau de la santé animale
La directive sur la lutte contre la peste porcine classique (PPC), qui
introduit de nouvelles dispositions visant à combattre plus efficacement la
maladie, entrera en vigueur dès demain dans les Etats membres. La PPC est
une maladie très grave qui touche les porcs domestiques et les sangliers.
Il n'y a aucun risque connu que le virus de la PPC puisse provoquer une
affection chez l'être humain, mais l'apparition de la maladie dans l'UE
crée un obstacle aux échanges internes et internationaux et les épidémies
de PPC peuvent causer d'importantes pertes économiques. Pour ces raisons et
d'autres liées au bien-être des animaux, son éradication dans l'UE est
l'une des priorités dans le domaine de la santé animale.
[15] Commission urges new government of Bosnia and Herzegovina to deepen
reforms
In a letter congratulating the new Presidency of Bosnia and Herzegovina,
the European Commissioner for External Relations Chris Patten has set out
the reforms that will be necessary for BiH to move forward steadily within
the Stabilisation and Association Process. These include implementation of
the 'Justice and Jobs' package, customs reform, implementation of BiH-wide
Value Added Tax, and the creation of a single economic space. The letter
reminds the incoming governments of their responsibility not only to
maintain, but step up, the pace of reforms, and promises the EU's
unstinting support, if this is delivered.
[16] EU and US issue best practices concerning bilateral cooperation in
merger cases
The European Commission and the US competition authorities have issued a
set of best practices on cooperation in reviewing mergers that require
approval on both sides of the Atlantic with a view to enhancing the good
relationship developed over the last decade.
[17] Commission announces stakeholder conference on new strategy for
pesticides
Monday 4 November the European Commission organises a major stakeholder
conference in the Centre Borshette on a new strategy for sustainable use of
pesticides. Environment Commissioner Margot Wallström will give the opening
speech at 9 am. The Commission presented its ideas for a strategy in a
communication in July 2002 (COM(2002)349, IP/02/996). The Commission wants
to reduce the risks from pesticides to farmers, consumers, and the
environment, whilst maintaining crop productivity. Environment Commissioner
Margot Wallström said : "We must make pesticide use sustainable, as
pesticides pose a risk to human health and the environment. The Commission
is working to make agricultural production less dependent on pesticides,
especially the most hazardous ones, as alternatives do already exist." In
the Communication, the Commission set out the following objectives : to
minimise the hazards and risks to health and environment from the use of
pesticides ; to improve controls on the use and distribution of pesticides;
to reduce the levels of harmful active substances, in particular by
replacing the most dangerous by safer (including non-chemical) alternatives
; to encourage the use of low-input or pesticide-free crop farming ; to
establish a transparent system for reporting and monitoring progress
including the development of appropriate indicators. The purpose of the
conference is to invite input from all stakeholders such as farmers, NGOs,
industry, other social partners and public authorities on the way forward.
