  • [01] Commission action results in reduced conversion charges for Euro-zone currencies The European Commission has decided to end the cartel proceedings against the Finnish, Irish, Belgian, Dutch and Portuguese banks accused of fixing conversion tariffs for euro-zone currency notes. This decision was taken after the banks decided to set prices independently from each other and to provide cheaper and more competitive services for customers. The action by the banks concerned, although coming quite some time after the Commisison initiated formal proceedings, will still benefit consumers during a significant period of time, including this year's main holiday season.
  • [02] La Commission autorise la création de Covisint, une bourse de commerce automobile sur Internet La Commission européenne a formellement autorisé Ford, DaimlerChrysler, General Motors, Renault et Nissan à créer l'entreprise commune Covisint, une bourse de commerce interentreprises sur Internet. La Commission a conclu que l'opération notifiée ne restreignait pas actuellement la concurrence au sens de l'article 81, paragraphe 1, CE.
  • [03] Commission allocates a further euro 3.3 million in humanitarian aid for Serbia The European Commission has earmarked euro 3.3 million in humanitarian aid for Serbia. Coming on top of the euro 34.4 million decided for Serbia in May 2001 (see IP/01/711), these funds will benefit the most vulnerable groups of the Serbian population providing up to 59,000 people with a hot meal every day for three months. The aid will be channelled through the humanitarian aid office ECHO which comes under the responsibility of Commissioner Poul Nielson.
  • [04] EU to observe elections for a Constituent Assembly in East Timor The European Commission has today adopted a decision to fund an EU Election Observation Mission (EOM) to monitor the forthcoming elections for a Constituent Assembly in East Timor. These elections are to be held on 30th August 2001. Wolfgang Kreissl-Doerfler MEP has been appointed as the Chief Observer of the EU Election Observation Mission. The Commission funding also provides for voter education actions to facilitate the full participation of the local population in these, the first free elections in East Timor. The EC funding decision represents a commitment of euro 1 million from the EC budget.
  • [05] Commission transmits Working Paper on Temelin to the Austrian and Czech authorities As part of the efforts to facilitate an understanding on the Temelin Nuclear Power Plant, the European Commission has today transmitted a Working Paper to the Prime Minister of the Czech Republic, Mr. Milos Zeman, and the Chancellor of Austria, Mr. Wolfgang Schüssel. The Paper summarises the outcome of the expert mission with trilateral participation established under the Melk Protocol (Chapter IV) of 12 December 2000.
  • [06] European Agency for Reconstruction publishes first Annual Report The European Agency for Reconstruction, which is responsible for the management of the main EU assistance programmes in the Republic of Serbia, Kosovo, and the Republic of Montenegro, has just published the Annual Report for 2000. The European Union, through the Agency, and through other instruments such as macro-financial, humanitarian, democratisation and food aid, as well as the bilateral contributions made by its Member States, is by far the largest provider of assistance to the Federal Republic of Yugoslavia. The Agency was established in February 2000, with its headquarters in Greece at Thessaloniki, and operational centres in Pristina, Belgrade and Podgorica. It now oversees a total portfolio of some euro 1 billion, with the total funds available under its 2001 assistance programme expected to rise to +/- euro 550 million. Its main areas of assistance are those of energy, infrastructure, housing and agriculture. The report is available in all 11 EU languages under the 'News &Publications' section of the Agency web-site at www.ear.eu.int
  • [07] Marchés publics : la Commission décide de demander à la France de respecter un arrêt de la Cour concernant la directive "Moyens de recours" La Commission européenne a décidé de transmettre une demande formelle à la France l'invitant à se conformer à un arrêt de la Cour de mai 1999 qui lui enjoignait d'appliquer pleinement et correctement la directive sur les procédures de recours ouvertes aux prestataires qui estiment avoir été injustement exclus de la passation d'un marché public dans les secteurs de l'eau, de l'énergie, des transports et des télécommunications. La demande se présente sous la forme d'un "avis motivé" relevant de la procédure d'infraction pour non-respect d'un arrêt de la Cour (article 228). Faute d'une réponse satisfaisante dans un délai de deux mois, la Commission peut décider d'assigner de nouveau la France devant la Cour et peut demander à cette dernière d'imposer une astreinte quotidienne à la France tant que la directive ne sera pas correctement appliquée.
  • [08] Public procurement : Commission pursues infringement proceedings against Spain, France, Germany, Italy and Austria The European Commission has decided to refer Spain to the EU's Court of Justice. The case against Spain concerns incorrect implementation of the Directives on public supply and works contracts (93/36/EEC & 93/37/EEC). The Commission has also decided to send formal requests to Germany, France, Italy and Austria to ensure the correct application of EU public procurement rules. The cases concern waste treatment in the Donau Wald area (Germany), a sewage plant in Le Mans (France), planning of school buildings in Genoa (Italy), the supply of operating tables for Ivrea Hospital (Italy) and the incorrect implementation of the remedies Directives (Austria). These formal requests take the form of so-called 'reasoned opinions', the second stage of infringement proceedings under Article 226 of the EC Treaty. In the absence of satisfactory replies from these Member States within two months following receipt of the reasoned opinions, the Commission may decide to refer the cases to the European Court of Justice. In addition, the Commission has decided to send two requests for information to France in the form of letters of formal notice, the first stage of Article 226 infringement proceedings. These two cases concern management contracts for public works and the terms and conditions for concluding local urban development agreements
  • [09] Détachement des travailleurs : la Commission poursuit une procédure d'infraction contre l'Allemagne Suite à une plainte d'une entreprise communautaire, la Commission européenne a décidé d'adresser une demande formelle à l'Allemagne pour non- conformité de certaines dispositions de sa législation, applicable en cas de détachement des travailleurs, avec les règles du traité CE (article 49) sur la libre prestation des services dans le marché intérieur. La Commission estime que ces dispositions sont discriminatoires à l'encontre des entreprises communautaires non établies en Allemagne qui détachent ou mettent à disposition leurs travailleurs en Allemagne aux fins d'y prester un service. La demande formelle à l'Allemagne sera transmise sous forme d'un avis motivé, au titre de la procédure d'infraction prévue à l'article 226 du traité CE. Si l'Allemagne ne se conformait pas à cette demande dans un délai de deux mois après réception de l'avis motivé, la Commission pourrait décider de saisir la Cour de Justice.
  • [10] Prévention et réduction intégrées de la pollution : la Commission prend des mesures contre le Luxembourg et la Belgique La Commission européenne a décidé de saisir la Cour européenne de justice contre le Luxembourg et la Belgique pour n'avoir pas appliqué la réglementation européenne en matière de pollution. Les dispositions communiquées par le Luxembourg comprennent des mesures de transposition partielle ainsi qu'un projet de législation qui n'est pas encore adopté. Pour ce qui est de la Belgique, les mesures adoptées pour la Wallonie n'ont pas été communiquées et les mesures notifiées pour Bruxelles semblent incomplètes. Margot Wallström, commissaire chargée de l'Environnement, a commenté les décisions en ces termes : "La directive IPCC est un pas essentiel dans la réglementation environnementale en matière de pollution d'origine industrielle. Je demande instamment aux Etats membres qui tardent à la transposer dans leur droit national de tout mettre en œuvre pour clôturer au plus vite les travaux législatifs nécessaires."
  • [11] La Commission prend des mesures à l'encontre de la Belgique, de l'Irlande, de l'Espagne et du Portugal en ce qui concerne la pollution par les nitrates La Commission européenne a décidé d'envoyer à l'Espagne une lettre de mise en demeure (premier avertissement écrit) parce que ce pays n'a pas adopté et transmis à la Commission des programmes action visant à réduire la pollution dans un certain nombre de zones vulnérables à la pollution par les nitrates. Une action devant la Cour de justice sera engagée contre la Belgique et l'Irlande pour des défaillances de même nature. La désignation par la Belgique des zones vulnérables et les programmes anti-pollution de ce pays ont été insuffisants. L'Irlande est actuellement le seul Etat membre à ne pas avoir désigné de zones vulnérables à la pollution par les nitrates ; l'action judiciaire portera sur ce manquement ainsi que sur l'absence de programme d'action dans ce domaine. Le Portugal recevra un avis motivé (deuxième avertissement écrit). La décision prise à l'encontre du Portugal concerne également le nombre insuffisant de zones vulnérable qui ont été désignées. Ces mesures témoignent des efforts permanents de la Commission en vue de réduire la pollution des eaux par des nitrates provenant de sources agricoles : une action judiciaire a été engagée contre la plupart des Etats membres. Commentant ces décisions, Margot Wallström, commissaire chargée de l'Environnement, a déclaré : "Il y a encore trop d'Etats membres qui accusent un retard en matière de réduction de la pollution par les nitrates, et ce malgré les engagements qu'ils ont pris en vertu de cette directive. Je regrette que la Commission doive prendre des mesures d'exécution pour attirer l'attention sur ces carences."
