[01] La Commission autorise le nouveau contrat de l'Association
pharmaceutique belge relatif à son label de qualité
Conformément aux règles de concurrence applicables aux accords et aux
pratiques concertées, la Commission européenne a donné son feu vert au
dernier contrat conclu entre l'Association pharmaceutique belge (APB) et
les fabricants de produits pharmaceutiques, qui autorise ces derniers à
apposer son label de qualité sur leurs produits. Les contrats de ce type,
concernant des produits tels que les dentifrices, les vitamines, les
shampoings, les produits cosmétiques et les aliments pour bébés, existent
depuis le milieu des années quatre-vingt. Conformément à ces contrats, les
fabricants peuvent soumettre leurs produits à un contrôle de qualité dans
un laboratoire de l'APB. Si leurs produits sont conformes, le label APB
peut être apposé sur leur emballage. Ce label constitue une garantie de
qualité.
[02] Commission approves joint venture between Conti Teves, Temic and Leica
Geosystems
The European Commission has approved the participation of Conti Teves,
Germany, in the existing joint venture ADC, Automotive Distance Control
Systeme GmbH, Germany. Temic Telefunken Microelectronic GmbH, Germany, and
Leica Geosystems AG, Switzerland, had set up ADC in 1996. The joint venture
is active in the development, manufacture, distribution and service of
distance control systems for the automobile industry. Conti Teves is a
group company of Continental AG, which is primarily active in the
manufacture of tyres for the automobile industry. Temic Telefunken belongs
to the DaimlerChrysler AG. The entry of a new shareholder does not change
the existing market position of ADC. In view of the existence of numerous
competitors, the Commission decided to approve the transaction and to
declare it compatible with the common market.
[03] EU-Japan ministerial meeting
(! embargo 12h30 pm !) At the first EU-Japan Ministerial meeting of the new
Millennium, held in Brussels today, the European Commission emphasised the
need to strengthen co-operation and dialogue with Japan across all domains
in pursuit of commonly held interests. The highlight of the meeting, which
focused on economic issues, was the adoption of an EU-Japan joint statement
on the WTO emphasising the importance both sides attach to the multilateral
trading system based on the WTO and the need to launch negotiations on a
New Round as soon as possible. The meeting also focused on the state of the
Japanese economy where the Commission encouraged Japan to press ahead with
vigorous regulatory reforms, referring in this context to its proposals of
November 1999.
[04] Médicaments : la Commission envoie un avis motivé à la France
La Commission européenne a décidé d'adresser un avis motivé aux autorités
françaises en raison des règles concernant les importations parallèles de
médicaments en France. L'avis motivé constitue la deuxième étape de la
procédure d'infraction. Dans l'absence d'une réponse satisfaisante dans les
deux mois suivant réception de l'avis motivé par la France, la Commission
pourrait saisir la Cour de justice européenne.
[05] Data protection : Commission takes five Member States to court
The European Commission has decided to take France, Luxembourg, the
Netherlands, Germany and Ireland to court for failure to notify all the
measures necessary to implement the directive on the protection of personal
data. This step represents the third formal stage of formal infringement
proceedings under Article 226 of the EC Treaty.
[06] Services financiers : procédures d'infraction contre le Luxembourg et
le Portugal
La Commission européenne a décidé de déférer le Luxembourg devant la Cour
de justice européenne pour non-transposition de la directive concernant les
systèmes d'indemnisation des investisseurs. La Commission a également
décidé d'envoyer un avis motivé (qui constitue la deuxième étape de la
procédure d'infraction) au Portugal pour transposition incomplète de cette
même directive. Si un Etat membre destinataire d'un avis motivé ne fournit
pas une réponse satisfaisante dans les deux mois qui suivent la réception
de l'avis, la Commission peut saisir la Cour de justice.
[07] Diplômes : la Commission poursuit des procédures d'infraction
relatives à des professions de la santé
La Commission européenne a décidé de poursuivre les procédures d'infraction
engagées contre l'Espagne, le Portugal, la France, les Pays-Bas et
l'Irlande pour manquement au droit communautaire en ce qui concerne la
reconnaissance des diplômes et formations de médecin, d'infirmier, de
dentiste et de gestionnaire hospitalier. Elle a décidé de traduire
l'Espagne devant la Cour de justice européenne pour non-respect des
critères minimums relatifs à la formation d'infirmier responsable des soins
généraux et de déférer les Pays-Bas, l'Irlande et le Portugal devant cette
même Cour pour non-transposition d'une modification apportée à la directive
relative aux diplômes de médecin. La Commission a également décidé
d'envoyer des avis motivés au Portugal (dentistes), à la France
(gestionnaires hospitaliers), ainsi qu'aux Pays-Bas, à l'Irlande, à
l'Espagne et au Portugal (médecins spécialistes). L'envoi d'un avis motivé
constitue la deuxième étape de la procédure d'infraction prévue à l'article
226 du traité CE. En l'absence d'une réponse satisfaisante de la part de
l'Etat membre concerné dans un délai de deux mois à compter de la date de
réception de cet avis, la Commission peut décider de saisir la Cour de
justice.
[08] Free movement of goods : Commission brings infringement proceedings
against Austria and Italy
In response to complaints, the European Commission has decided to bring
infringement proceedings against Austria and Italy for unjustifiably
blocking the free movement of goods. Austria will be brought before the
European Court of Justice for blocking the marketing of vitamin-enriched
food supplements from other Member States. The Commission has also decided
to send two reasoned opinions to Austria, one relating to its legislation
on parallel imports of pesticides and the other to road signs. A decision
was also taken to send a reasoned opinion to Italy on account of the
obstacles to the free movement of raw gold. The reasoned opinion is the
second stage in the infringement proceedings provided for in Article 226 of
the EC Treaty. In the absence of a satisfactory reply within the two months
following receipt of the reasoned opinion, the Commission may refer the
case to the Court of Justice.
[09] Commission decides Court action against Ireland for non-respect of the
Drinking Water Directive
The European Commission has decided to make an application to the European
Court of Justice against Ireland for non-respect of the European Union's
Drinking Water Directive. This action relates to the widespread non-
compliance of Irish drinking water supplies with the standards set out in
the directive, as well as weaknesses in the Irish legislation relating to
privately-run supplies in rural areas (group water supplies).
[10] Eaux de baignade : la Commission prend des mesures à l'encontre de
plusieurs Etats membres
La Commission européenne a décidé d'adresser un avis motivé en application
de l'article 228 (ex article 171) du traité CE au Royaume-Uni, pour non-
respect de la directive communautaire relative aux eaux de baignade dans
les stations balnéaires de Blackpool et Southport, dans le nord de
l'Angleterre. Elle a également décidé, pour infraction à la même directive,
de former un recours devant la Cour de justice contre la France, qui,
depuis 1995, n'a pas contrôlé les eaux de baignade au regard de l'important
critère des "coliformes totaux". La Commission assigne également la France
et les Pays-Bas devant la Cour et adresse un avis motivé à la Suède et à
l'Italie pour non-respect de certains critères et d'obligations
d'échantillonnage prévus dans la directive sur les eaux de baignade.
[11] Commission goes to Court against Ireland for failure to comply with EU
Asbestos Directive
The European Commission has decided to bring Ireland before the European
Court of Justice for failing to transpose properly into its national
legislation a Community Directive aimed at controlling environmental
pollution from asbestos. In particular, the infringement concerns the
Directive's provisions concerning asbestos removal involving the release of
asbestos fibres.
[12] Habitats Directive : Commission takes further steps against several
Member States
The European Commission has decided to make an application to the European
Court of Justice against Sweden and the United Kingdom for failure to send
to the Commission a complete list of sites of potential importance for the
establishment of the EU Habitats Conservation (Natura 2000) Network. The
Commission has also decided to send a Reasoned Opinion to Belgium and
Luxembourg for failure to properly transpose the Habitats Directive into
their national legislation.
