  • [01] Services : Commission decides to pursue infringement procedures against Italy, Germany, Portugal and Belgium

    As a result of obstacles preventing temporary employment agencies based in other Member States from offering their services in Italy, the European Commission has decided to refer Italy to the European Court of Justice. It has also decided to refer Germany to the Court for discriminatory rules concerning workers on secondment from another Member State. In addition, the Commission has decided to send reasoned opinions to Germany and Portugal concerning provision of services by patent agents and to Belgium concerning discriminatory rules for the registration of companies. In the Commission's view, all these barriers violate EC Treaty rules on freedom to provide services (Article 49, ex-59) or freedom of establishment (Article 43, ex-52). In the case of the reasoned opinions, if the Commission does not receive a satisfactory response within two months of receipt by the Member State in question, it may decide to refer the case to the Court.

    [02] Fiscalité - procédures d'infraction

    La Commission européenne a décidé de saisir la Cour de Justice européenne à l'encontre de la France parce qu'elle exige que les véhicules utilisés pour l'enseignement soient affectés exclusivement à cette activité pour pouvoir bénéficier du droit à déduction de la TVA. La Commission a également décidé d'envoyer un avis motivé (la seconde étape des procédures en infraction au sens de l'article 226 du Traité) à la Grèce. Ce pays, en appliquant un taux réduit d'accises à l'alcool utilisé pour fabriquer l'ouzo (boisson spiritueuse produite exclusivement en Grèce), viole l'article 90 du Traité (interdiction de taxes discriminatoires). En l'absence d'une réponse satisfaisante dans un délai de deux mois après réception de l'avis motivé, la Commission peut décider de porter l'affaire devant la Cour de Justice.
