  • [01] EU/US banana dispute : unilateral action is not in line with WTO rules

    The European Union (EU) has adopted a new trading arrangement for imports of bananas into the EU which will enter into force on January 1st 1999. The EU has fundamentally corrected all six elements of the previous system that were found inconsistent with World Trade Organisation (WTO) rules. In spite of this, the US Administration has announced that it is preparing unilateral retaliatory measures against the EU. Such unilateral action is not in line with WTO rules, and threatens to undermine the entire WTO system. It also unnecessarily strains EU/US relations at a time when both major trading partners have to work closely together to alleviate the burden of a looming world-wide economic downturn. If the US persists with this unilateral action, the EU will have no choice but to challenge it in the WTO.

    [02] Proposition de prix d'orientation des produits de la pêche pour 1999 : une conjoncture très favorable

    La Commission européenne a adopté sa proposition annuelle de prix d'orientation pour les produits de la pêche frais/réfrigérés et congelés, ainsi que les prix du thon pour la conserverie. D'une façon générale, l'évolution des prix en 1998 a été très positive, particulièrement pour les poissons blancs, en raison d'une baisse quasi généralisée des captures conjuguée à une augmentation de la demande au niveau mondial. Le Conseil des Ministres devra prendre sa décision sur la base des propositions de la Commission avant la fin de l'année.

    [03] Commission approves the acquisition by Edeka of joint control over Adeg Austria

    The European Commission approved an operation whereby Chiemgau and Südbayern, two retail and wholesale companies belonging to the German EDEKA Group, together with the cooperative society ADEG Österreich Genossenschaft (AÖGen) acquire joint control over the undertaking ADEG Österreich Handels- aktiengesellschaft (AÖAG). The relevant market concerned is the retail market for fast moving daily consumer goods. The concentration on the retail side does not cause any overlaps since Chiemgau and Südbayern are not active on the Austrian retail market, leaving aside two retail outlets in Salzburg and Braunau, and AÖAG is not present in Germany. The operation is appropriate to strengthen the market position of AÖAG on the supply side with regard to certain products where joint purchase with EDEKA is envisaged. However, considering the rather small market shares of AÖAG compared to the market leaders, the creation of a dominant position of AÖAG can be excluded with any alternative geographical market definition.

    [04] Commission authorises joint venture Arlington (USA) / Lufthansa (Germany) to acquire control of "European Kitchens"

    The European Commission has approved the creation of a joint venture in the airline catering sector, by which Arlington Services Holding Co. (Arlington) controlled by Onex Food Services Inc. (OFS) and Lufthansa Service Holding AG (LSG) will acquire joint control of "European Kitchens". The proposed acquisition has to be seen as a structural change that has a relatively insignificant impact on the market.

    [05] L'UE destinera 28 millions d'Ecus à la lutte contre la drogue au Pérou

    En vue d'examiner la demande d'appui financier présentée par les autorités péruviennes pour la lutte contre la drogue, aujourd'hui et demain se tient à Bruxelles une réunion des bailleurs de fonds. Cet événement, organisé par la Banque Inter-américaine de Développement (BID) et l'Organisation des Etats Américains (OEA) en collaboration avec la Commission européenne, réunit 150 délégués appartenant à trente délégations différentes. M. Enrique Iglesias, Président de la BID, M. Manuel Marin, Vice-Président de la Commission, M. Alberto Pandolfi, Premier Ministre péruvien, M. Cesar Gaviria, Secrétaire général de l'OEA, M. Pino Arlacchi, Directeur du Bureau des Nations Unies pour la Lutte contre la Drogue (UNDCP) et Mme Benita Ferrero-Waldner, Secrétaire d'Etat aux Affaires Etrangères de l'Autriche (présidence en exercice du Conseil de l'Union européenne (UE), ont participé à la séance d'ouverture. L'UE annoncera à l'occasion de cette conférence des donateurs sur le Pérou son intention de considérer le financement dans ce pays d'un très important projet de développement alternatif d'un montant de 28 millions d'Ecus, dans une région de la cordillère des Andes dénommée Pozuzo/Palcazu, qui devrait intéresser 50.000 personnes environ. Cette initiative se fondera sur la mise en place d'une méthodologie participative, basée sur un dialogue approfondi avec les populations locales, en vue d'améliorer leur niveau de vie et favoriser le développement économique d'une zone particulièrement inaccessible et arriérée du pays. Il est prévu que cette initiative soit soumise à l'examen des quinze Etats Membres de l'UE au début du mois de décembre prochain.

    [06] Commission adopts Regulation clarifying the scope of the ban on the export of hazardous waste to non-OECD countries

    The European Commission has adopted a Regulation clarifying the scope of the prohibition to export hazardous waste to non-OECD countries. The Regulation amends Council Regulation (EEC) N° 259/93 on the supervision and control of shipments of waste. It transposes into the European Union (EU) law the lists of hazardous and non-hazardous wastes which, on a joint initiative of the EU and Chile were adopted in the context of the Fourth Conference of the Parties to the Basel Convention in February this year in Kuching, Malaysia. Going beyond what was decided in the context of the Basel Convention, the new Regulation also provides for the export ban to cover the wastes listed in the EU's Hazardous Waste List. Also covered are those wastes, the export of which is considered to present a risk for the environment under EU law and which are annexed to the Shipment Regulation as the "Amber" and "Red" list. This possibility to apply stricter standards than under the Basel Convention is limited to those cases, where the wastes in question are not at the same time covered by the Basel list of non-hazardous wastes. However, the new Regulation explicitly foresees the possibility of future amendments of the EU scope of the export ban, which may be stricter than what has been decided in the context of the Basel Convention. Overall, the Regulation provides full protection to developing countries from exports of wastes classified as hazardous under the Basel Convention and under EU legislation.

    [07] Aide humanitaire : nouvelles en bref

    La Commission européenne a donné le feu vert à des projets humanitaires en faveur de l'Azerbaïdjan (500.000 Ecus), de l'Inde (500.000 Ecus), du Kenya (75.000 Ecus) et du Tchad (300.000 Ecus). L'aide, gérée par l'Office humanitaire de la Communauté européenne (ECHO) permettra aux organisations non gouvernementales de mener à bien des projets à court terme.
