[I] Résultats de la Commission du 30 juillet 1997 - Outcome of

[01] Commission to recover a further ECU 110.8 million of 1993 CAP
expenditure from the Member States
The European Commission decided to claw back ECU 110.8 million paid out by
some Member States in 1993 under the Common Agricultural Policy (CAP).
This brings the total CAP expenditure rejected under Commission decisions
this year to ECU 649.8 million (an earlier decision in April rejected ECU
539 million ). The budgetary corrections decided upon were left aside in
the April decision as they were still subject to discussion under the
conciliation procedure (a procedure whereby the Member State concerned and
the Commission discuss the basis for the correction with a group of
independant experts). The funds recovered relate to CAP expenditure in
Spain, France, Italy and the United Kingdom. The clearance of accounts
permits the recovery from the Member States of sums that they have paid out
without sufficient guarantees as to the legitimacy of these payments or
the reliability of Member States' control and verification system. The
size of the financial corrections which are imposed upon them constitute a
strong incentive for them to make progress in this area.

[02] Statement by Jacques Santer on the bomb attempt in Jerusalem
European Commission's President, Jacques Santer, yesterday sent a
telegramme to Israel Prime Minister, Benjamin Netanyahu, and made the
following statement: "I was shocked to hear of the tragedy that occured
today at Shuk Mahane Yehuda in Jerusalem, which claimed so many innocent
lives. On behalf of the European Commission and on my own behalf, allow me
to express my condolences to the bereaved families and heartfelt wishes for
the speedy recovery of the injured."
[03] Dynamisme du commerce de l'UE avec le reste du monde
Le commerce de l'Union européenne (UE) avec les pays tiers a été
particulièrement dynamique au cours du premier trimestre 1997 selon les
données publiées aujourd'hui par Eurostat, l'Office statistique des
Communautés européennes à Luxembourg. Les exportations et les importations
extra-UE ont augmenté respectivement de 9,9% et 8,4% (4% et 6,3% au premier
trimestre 1996). La croissance des exportations extra-UE a été
particulièrement forte en Irlande (17,5%), au Royaume-Uni (26,2%) et en
Belgique-Luxembourg (16,5%). Les exportations ont toutefois été en baisse
au Danemark (-3,8%), en Espagne (-1,8%) et au Portugal (-2,9%). En ce qui
concerne les importations, le Royaume-Uni (16,3%), la Finlande (9,4%), le
Danemark (9,4%) et la France (12,1%) ont connu des hausses supérieures à la
moyenne. Eurostat estime que l'excédent commercial de l'UE avec les pays
tiers a atteint 3,5 milliards d'Ecus au cours du premier trimestre; il
était de 1,2 milliard à la même période de l'année dernière.
[04] Libre circulation des produits: procédures d'infraction contre la
Grèce, l'Italie, l'Allemagne, la Belgique, la Suède, le Royaume-Uni et le
Portugal
La Commission européenne a décidé de saisir la Cour de Justice dans deux
cas: la Grèce maintient des mesures nationales discriminant les
importations du ciment des autres Etats membres et l'Italie exige pour
certains miels un étiquetage et une dénomination qui sont contraires aux
règles communautaires. De plus, la Commission a décidé d'envoyer des avis
motivés (seconde étape de la procédure d'infraction prévue par l'article
169 du traité) à cinq Etats membres pour les raisons suivantes: l'Allemagne
maintient des exigences disciminatoires pour l'importateur parallèle de
médicaments. Une loi belge fait obstacle à la mise sur son marché de
certains dérivés sanguins pourtant munis d'une autorisation communautaire.
La Suède demande le paiement d'une redevance nationale aux titulaires d'une
autorisation communautaire de mise sur le marché des médicaments alors
qu'ils ont déjà acquitté une redevance communautaire. Le Royaume-Uni ne
prend pas de mesures suffisantes afin d'assurer que ne soient mis sur le
marché comme compléments alimentaires des médicaments à base de plantes.
Enfin, le Portugal n'a pas correctement transposé la directive sur
l'équipement de protection individuelle.
[05] Company taxation: Commission pursues infringement proceedings against
France and Greece
The European Commission has sent France a reasoned opinion (the second
stage of formal infringement proceedings under Article 169 of the EC
Treaty) for applying a discriminatory tax regime to the profits of French
permanent establishments of companies from other Member States. The
Commission has also decided to refer Greece to the Court of Justice for
violating the capital duty Directive (69/335/EEC). The infringement
concerns the rate of the capital duty charged on raising capital for the
formation of a company or increasing it, and the practice in Greece of
imposing a charge for the lawyers' social fund, over and above capital duty,
on the same operations.
[06] Marché unique - procédures d'infraction pour non-communication des
mesures nationales de transposition
La Commission européenne a décidé de saisir la Cour de justice et d'envoyer
des avis motivés (la deuxième étape de la procédure d'infraction) dans 26
cas dans lesquels les Etats membres ont manqué à l'obligation de transposer
des Directives marché unique dans les délais requis. Il s'agit de
Directives dans les domaines de l'élimination des contrôles aux frontières
(oeuvres d'art), les services financiers, le droit des sociétés, la
reconnaissance des diplômes et la propriété intellectuelle. En ce qui
concerne les avis motivés, en l'absence de réponse satisfaisante dans un
délai de deux mois suivant réception de l'avis motivé, la Commission
pourrait saisir la Cour de justice de ces affaires.
[07] Commission supports Urban renewal in Brighton, Coventry, Bristol and
Merseyside
The City of Brighton in the South East, the City of Coventry in the West
Midlands and the City of Bristol in the South West of England are to
receive about ECU 4.5 million each from the European Union's (EU)
Structural Funds for urban renewal. The money comes from the EU's Urban
initiative and is specially targeted at disadvantaged areas suffering from
severe unemployment, high crime levels, poverty-related depreciation, poor
housing condition, few social and community facilities and low education.
It will be channelled via programmes of investments tailored to the
specific needs and potential of the different communities. Merseyside,
which has already benefited from a European Structural Fund contribution of
ECU 17.3 million, will receive an extra ECU 2.2 million to cover a new sub-
programme for the area of Leasowe.
[08] Trois régions françaises reçoivent une aide communautaire de 273,4
millions d'Ecus pour la restructuration industrielle
La Commission européenne soutiendra la reconversion économique et la
restructuration industrielle en Haute-Normandie, en Franche-Comté et dans
le Midi-Pyrénée par l'octroi d'une aide financière de 273,4 millions d'Ecus,
répartis entre 218,5 millions d'Ecus du Fonds européen de développement
régional (FEDER) et 54,9 millions d'Ecus du Fonds social européen (FSE).
Les programmes auxquels elle vient de donner le feu vert pour la période
1997-1999 visent essentiellement à redresser la situation de l'emploi dans
les zones en déclin industriel et au taux de chômage nettement supérieur à
la moyenne française. Au total ce sont plusieurs milliers d'emplois qui
devraient être créés ou sauvegardés grâce à une série de mesures en faveur
des entreprises, de la formation, du renforcement de l'innovation
technologique, de la protection de l'environnement et de la diversification
des activités. Le coût total de ces programmes, financements nationaux et
fonds privés compris, atteint les 800 millions d'Ecus.
[09] Commission mixte extraordinaire dans le cadre de l'accord de pêche UE-
Maroc
La Commission européenne a saisi les autorités marocaines en vue de la
convocation d'une réunion extraordinaire de la Commission Mixte de la Pêche
Union européenne (UE)-Maroc, entre le 11 et le 13 août prochain, à
Bruxelles. "Je défendrai toujours une application stricte des règles du jeu,
encore faut-il que ces règles soient appliquées de façon transparente, car
c'est la meilleure manière d'assurer l'équité", a déclaré Emma Bonino,
Commissaire responsable e.a. de la Pêche, suite à l'arraisonnement par les
autorités marocaines, le 16 juillet dernier, d'un navire de l'UE autorisé à
opérer dans les eaux du Maroc. Les faits qui ont motivé l'arraisonnement
du navire "Albor uno", qui constitue le septième arraisonnement d'un navire
de l'UE dans les eaux marocaines depuis le début de l'année, divergent
selon les parties. Alors que Mme Bonino avait formulé lors de sa dernière
visite au Maroc, à l'occasion du Partenariat-Pêche à Casablanca en mai
dernier, sa "volonté d'établir un code de conduite destiné à encadrer les
procédures d'arraisonnement des navires", ce nouvel événement a conduit la
Commission à convoquer une réunion extraordinaire pour s'assurer que les
procédures administratives et juridictionnelles soient mises en oeuvre par
les autorités marocaines conformément aux dispositions pertinentes de
l'accord de pêche et autres dispositions nationales applicables aux navires
de pêche de l'UE autorisés.
[10] Wide-screen TV Action Plan bows out - results of final call for
proposals and World Cup football in wide-screen
The European Commission has made the final allocations of funding under the
European Union Action Plan to promote wide-screen television services and
programme production in the 16:9 format. Eighteen broadcasters will
receive ECU 7.8 million of funding for transmitting around 4000 hours of
wide-screen transmissions between now and the end of 1998. In addition,
the programme production part of the Action Plan makes available a further
ECU 9.5 million to 450 programme projects equivalent to 2000 hours of wide-
screen programming. The action plan consists of two parts, one supporting
broadcasters to transmit in the new format, and the other helping producers
to make new programmes. Furthermore the Commission allocated ECU 1.4
million towards the additional costs incurred by Television Radio Services
98 (TVRS 98) for producing and transmitting next year's World Cup football
competition in France in wide-screen alongside the traditional 4/3 format.
The funding will enable TVRS 98 - a consortium of French broadcasters
responsible for organising World Cup broadcast coverage - to offer wide-
screen pictures to broadcasters all over Europe.
[11] New deadline for the comments on Green paper on European Food law
The European Commission has postponed the deadline for the comments on the
Green Paper on the European Food Law to 19 September 1997. A Green Paper
on European Food Law was published on 30 April 1997 with the aim of
launching a public debate on the extent to which current legislation on
foodstuffs meets the needs and expectations of consumers, producers,
manufacturers and traders and the extent to which measures to ensure
independence, objectivity, equivalence and effectiveness of the control and
inspection systems are meeting their basic objectives to ensure a safe and
wholesome supply. The original deadline for comments was the 31st July
1997. The Commission has already received a large number of comments also
well many requests to extend the deadline. Comments should be sent to "The
European Commission, Directorate General for Industry (Green Paper on Food
Law)-200 Rue de la Loi (RP 11 3/1), B-1049 Brussels". The next step will be
a conference on Food Law and Food policy organised jointly by the European
Parliament and the European Commission on 3-4 November in the premises of
the European Parliament in Brussels. As part of its preparation for the
conference the Commission will make available as many of the comments as
possible which have been received before 19th September.
[12] All-star football tournament against racism - 12 October 1997
As part of the European Year Against Racism, the AIFP (International
Association of Professional Footballers), in cooperation with the European
Commission and under the patronage of Social Affairs Commissioner Padraig
Flynn, has taken the initiative to organise an all-star football tournament
against racism. This tournament will be held on 12 October 1997 in Spain.
It will bring together some of the best football players in the world,
united in their determination to show that racism has no place in our
societies. The tournament will involve three all-star teams, captained by
Diego Maradona, George Weah and Eric Cantona. Each match will last 40
minutes. Further details, together with information about press
accreditation, will be given at a press conference at the beginning of
September.
