  • [01] CHRISTOFIAS - CYPRUS TALKS

President of the Republic of Cyprus Demetris Christofias said on Thursday that he expected better results from the ongoing talks, he is engaged in with the leader of the Turkish Cypriot community, noting that so far he is not too happy.

``I am glad that together with (Turkish Cypriot leader Mehmet Ali) Talat we put an end to the deadlock but I am not so happy because of the way we handle the negotiations and because of the results. I expected better results,`` he told a reception hosted by French Ambassador to Cyprus Nicolas Galey, to mark the end of the EU French presidency.

UN led talks between Christofias and Talat began on September 3 and so far 12 meetings have taken place focusing governance, power sharing and foreign relations.

``My vision is to reunite the people. I want to serve together with Mr Talat the Cypriots, without separating Greek Cypriots and Turkish Cypriots,`` he stressed, recalling that his sole aim for which he ran for the presidency of the Republic earlier this year was to bring about a solution to the Cyprus problem based on principles, the UN relevant resolutions and the High Level agreements, of 1977 and 1979 which provide for bizonal bicommunal federation.

Addressing the foreign ambassadors, attending the reception, the President said he did not want to accuse Talat or Turkey and added: ``you, as good diplomats, understand very well who is who and how he is handling the whole problem.``

``From my side I say once again I am full of good will for the solution of the problem. Of course, I am not ready for a solution which is not going to serve the real interest of the whole people of Cyprus,`` he stressed.

Christofias praised French President`s Nicolas Sarkozy actions, as President of the European Council, in the wake of the global financial crisis as well as during the conflict between Georgia and Russia. ``He handled the whole matter as a master of politics,`` he added.

Regarding the financial crisis, Christofias said that the EU ``must handle the issue collectively.``

Addressing Christofias, the French Ambassador expressed sorrow for the death of former President Tassos Papadopoulos.

Galey praised Christofias actions which led to the commencement of the talks for a political settlement. ``Your actions paved the way for the start of the talks on September 3,`` he said.

    [02] ECJ - AG - ORAMS CASE

The Advocate General of the Court of Justice of the European Communities believes that courts in European Union member states have an obligation to recognise and enforce judgments relating to property disputes, issued by Cypriot courts.

This, the AG said, in spite of the fact that Cypriot courts cannot actually enforce these judgments, due to the fact that the government of Cyprus is prevented by the continuing Turkish occupation - from exercising its jurisdiction in the area where the said property lies, which is the northern part of the country.

Advocate General of the Court of Justice of the European Communities, Julianne Kokkot, in her opinion on the Apostolides v Orams case, said a judgment issued by a court of the Republic of Cyprus must be recognised and enforced in the other EU member states, even where it relates to land in the Turkish occupied north of Cyprus.

In her opinion, the AG notes that such recognition and enforcement is not precluded by the fact that, pending resolution of the Cyprus problem, the application of Community law is suspended in those areas of the Republic of Cyprus in which the Government of the Republic of Cyprus does not exercise effective control.

[03] ATTORNEY GENERAL - AG OPINION

Attorney General Petros Clerides has described as a very positive development the opinion of the Advocate General of the Court of Justice of the European Communities that courts in European Union member states have an obligation to recognise and enforce judgments relating to property disputes, issued by Cypriot courts.

Clerides said that the content of Kokkots opinion is very positive, since all the arguments put forward by Apostolides and the Republic of Cyprus have been adopted.

He noted however that Kokkots recommendations do not constitute a Court decision and that her recommendations may not be adopted by the Court of Justice.

    [04] EU - CYPRUS - DROUGHT

The Cypriot authorities will be receiving 7.6 million euros from the EU Solidarity Fund, towards covering damage caused by the drought in Cyprus.

The European Parliament gave the go ahead for the immediate activation of the Solidarity Fund, adopting a relevant report by German MEP Reimer Boge.

The Fund mainly intervenes in cases of natural disasters, with serious repercussions on living conditions, the natural environment or the economy of one or more regions of a member state or candidate for accession country.

Cyprus has been hit by severe drought and has restricted water supplies to households, in addition to importing water from Greece to meet the water needs of the country.
