[01] Euro Court hearing on case against Turkey

The Court is expected to reserve judgement on the matter for a later date, probably in April or May next year.

Legal experts have explained the Court is not necessarily obliged to order payment of damages, if it considers that its December 1996 ruling on the case is sufficient satisfaction for the applicant.

The December ruling found Turkey guilty of continuous human rights violations with respect to the peaceful enjoyment of Titina Loizidou's property.

It ordered that within the next six months the applicant and the Turkish government submit written observations with respect to the issue of compensation and costs.

This is the first time an international legal body has condemned Turkey of human rights violations as a result of the continuing Turkish occupation of Cyprus' northern areas.

The Court's ruling is also a severe blow to efforts by the self-styled Turkish Cypriot regime to seek international recognition, as it acknowledges that the sole legitimate government in Cyprus is that of the Republic of Cyprus.

The same legal experts told CNA they hope the Court will rule in favour of compensation for moral and pecuniary damage.

They added that any judgement of the Court for any payment or other remedy has always been honoured by all the countries that have subscribed to the European Convention of Human Rights, under which their citizens have the right of an individual recourse to the Court.

They also explained that Loizidou's case deals with two dimensions at this stage. One concerns compensation and the second, which is not related to the Court, refers to compliance with the December ruling.

Loizidou is represented by Achilleas Demetriades, prominent Nicosia lawyer, who left today for Strasbourg, France, where the Court sits.

The Court is expected to hear on Thursday arguments from Attorney- General Alecos Markides, representing the government of Cyprus, Stephan Trechsel, president of the European Commission of Human Rights and others, as well as representatives of the Turkish government.

The December ruling said Loizidou was and still remains the legal owner of the property she has in occupied Cyprus.

[03] Turkey urged to assist Cyprus solution

This was pointed out to Turkey's premier Mesut Yilmaz by his Italian counterpart Romano Prodi, a press release, issued by Prodi's office, said after the two met in Rome, Monday.

Italy, the press release said, hopes that Turkey will consolidate its European orientation through specific moves in the improvement of its human rights record and its relations with Greece, and the adoption of a constructive position on the question of Cyprus, in view of the island's accession to the European Union.

The Italian PM, it added, reaffirmed his government's commitment to continue efforts to secure Turkey a place in an enlarged European Conference for candidate countries for EU accession.

Prodi said such a process would favour Turkey's prospects for EU membership, once the country's authorities fulfill Europe's expectations on fundamental issues.

The European Commission formally agreed in July to invite Cyprus for EU membership talks. Turkey was not included in the list of countries to participate in these talks.

The Commission offered Turkey a consolation prize by calling for closer links.
